Parliament Under Attack by its Protector by Senator A. Rehman Malik
I would like to begin with sincere
thanks to the chief justice of Pakistan who has reminded us that the entire
Parliament is supreme. He has stated, “We heard the other day people were
condemning the Parliament, but for us it is supreme.”
Our chief justice of Pakistan always
talks with correct reference as brought in the great legal simply by the name
of Baba Rehmat and his statement prompted me to write an article on Baba
Rehmat, which was published on 22nd December 2017 and I had referred Baba
Rehmat as “Rule of law and constitution”. The country is run through the
Constitution of Pakistan and laws are enacted through legislation in the
Parliament and an Act so passed by the Parliament is called ‘Act of Parliament’
and this enactment provides the force of law to implement “rule of law.”
The same rule of law is applied on
all institutions including political parties/politicians and general public. In
simple words, the Parliament is centre of creation of laws and its
implementation is through the rule of law. The country cannot have democracy if
there is no parliament. The Parliament consists of a president, National
Assembly and the Senate and abusing the Parliament is similar to abusing these
three institutions. The president is also supreme commander of Armed Forces
too. Indirectly this ball of “curse” has been thrown on the armed forces and
other constitutional institutions. Please curse your political opponents but
not the Parliament as an institution as it is future of Pakistan and a hope for
many to serve the nation through this Parliament.
The Parliament comes into being with
the power of people and abusing Parliament means abusing its voters and people
of Pakistan. If you are abusing the Parliament being a member how will you go
back to the masses for vote again when you have already cursed and dehumanised
the same Parliament. Does any law allow anybody to abuse the Parliament? The
people of Pakistan gave you licence to make legislations and not to abuse this
house of democracy and hope of people.
Parliament is attacked by none other
than its own members who have got their fame only because of this Parliament.
I, therefore, in humble capacity warn my countrymen that some politicians are
creating a situation and pushing the democracy to an end. Please save it. If
parliamentarians do not respect Parliament then why should someone else respect
it? I warn/advise such elements not to confront constitutional
institutions/parliament as it may cause irreversible loss to the on-going
democratic system. We have had many incidents in the past when some politicians
played dirty to diminish the Parliament; some enjoyed their ministerial
positions while some kept waiting to benefit from the dictator rule.
Our nation has experienced the
dissolution of Parliament in the past - first time the Constituent Assembly of
Pakistan was dissolved on October 24, 1954, by Governor General Malik Ghulam
Muhammad. The dissolution was challenged by the president of the assembly in
the notable case of Maulvi Tamizuddin Khan vs. Federation of Pakistan in which
the federal court took the side of the governor general, in spite of dissent
from one judge. Mohammad Ali Bogra was the Prime Minister of Pakistan at the
time.
The second Constituent Assembly
reconstituted on May 28, 1955. The constitution was promulgated on March 23,
1956, and Pakistan became an Islamic republic. On October 7, 1958, martial law
was imposed on the country. The new regime abrogated the constitution,
declaring it unworkable. The 1973 Constitution came into effect on August 14,
1973. On the same day, Bhutto took over as the prime minister and Chaudhry
Fazal Elahi as the president. On July 5, 1977, General Zia staged a military
coup and suspended the Constitution, which was restored in 1985. Similarly,
when General Musharraf took over in 1999, the Constitution was suspended for
several years.
PTI has been hitting hard slogans
right from the beginning and Imran Khan heavily bashed Parliament in his dharna
in 2014 and the nation witnessed how his protesters entered in the Parliament.
Few politicians including Imran Khan
and Sheikh Rashid continued to show disliking for Parliament. The last bashing
with unparliamentary words came from Imran Khan and his associate standing on
the Charing Cross, Lahore, which was severe attack and this part of speech was
not the mandate given by the APC as I was also the part of the said APC. The
mandate was to demand for justice for Model Town victims. However, it looked
like the script written by PTI and its associates encountered something
horribly wrong. The other attacks is reaching through media on daily basis that
Parliament is going to be dissolved and every coming day bringing fear of
sacking of Parliament.
The rumours of dissolution of
Parliament are being in the air in the capital by anti-Parliament lobbies ready
with self-promised portfolios, and their political supporters and associates
are continuously engineering this propaganda. Some are ready with their
Sherwanis with their selected portfolios. The capital experienced an incident
of impersonation recently where a retired colonel along with his wife stripped
someone with millions of rupees on the false promise to get him a ministerial
slot in technocratic set up and hope the police will take it to its logical
conclusion to get him convicted as presently he is in police custody.
There are multi-directional attacks
on Parliament, which is the symbol of our democracy. It is unfair to condemn
Parliament if one is not been able to become the PM. This kind of abusive
attitude towards the Parliament based on selfish motives and odd ill desires
must not be acceptable by the nation. It is straight advice to them that either
take or leave it but do not act to demolish it.
Moreover, please do not treat Parliament
as Legoland to play like babies with blocks to make it and then break it in
childish way to draw childish happiness. We need political maturity in some of
our leaders who should rise above Legoland like game and the lust of power and
they must play role in building the democratic institutions and indulge in its
destruction.
No politician or individual has the
licence to condemn the parliaments or its members as it is the will of the
people there. Our history shows that it is always some politicians who have
been engineering the conspiracies against their own Parliament just for their
own motives and our constitutional and Parliament history is full of such moves
by politicians and even letters on record requesting the Army to intervene. Air
Martial ® Asghar Khan has gone to grave with his infamous undemocratic letter,
which will remain in the history of Pakistan.
We have been noticing the recent
developments how the Army was being asked to intervene during the longest
sit-in conducted by PTI in 2014 but the Army avoided and the entire credit goes
to the Army in keeping the democracy intact. Some politicians have created the
same situation again now and trying their best to have democratic system wound
up. I will give full credit to the present COAS who is supportive of democratic
system and he proved it by submitting his briefing in the Senate in camera and
briefed the Senate by sending clear and loud message that he is part of the
constitutional system as he stands for democracy.
This sheer dispersion in some
politicians to dissolve the Parliament may inflict the system and this
unfortunate lust of power to get into power may create space for invisible
forces and such politicians will still not get their power from this power
hungry game. Wait for your turn and go back to the people in the election and
ask for your mandate.
Abusing Parliament will lower your
respect as you are also the member of the same Parliament and in fact
Parliament is the mother of democracy and hence do not humiliate this institution
and its members.
I have my appeal not to diminish your
Parliament as it is shelter for the institutions which provides you force of
legislations. Make yourself accountable as how many legislations did you bring
in the Parliament to strengthen the rule of law. As parliamentarian it was your
duty to propose laws and not to hurl abuses to the Parliament as abuses do not
constitute law but undermines your stature.
I advise you to stop attacking our
Parliament/House of people otherwise you all will be repenting for subjective
and tutored unconstitutional moves. Be a parliamentarian, be a law-abiding
citizen and be a lover of Parliament and try to block the indirect and direct
attacks on Parliament, which is your own icon of democracy.
I have taken these abusive statements
as preamble of resignation from a party in KPK and Federation. You all must try
and halt it if you can.

Unjustified ‘special watch’ by USA for so-called violations of religious freedom by Senator A. Rehman Malik
It is unfortunate that USA under
President Donald Trump consistently trying to damage Pakistan through leveling
baseless and imaginative and unjustified allegations, ranging from allegedly
“providing safe havens to terrorists including Haqqani network to now religious
discriminations in the country.
President Donald Trump sometimes demands do more on unspecific and confused terminologies just to cover up its own failures in the so-called ‘war on terror’. When all allegations proved baseless it started harping on new tune of alleged protection of Haqqani network by Pakistan despite the fact that the CIA was fully aware of the actual protectors of the network where it is now completely under the protection of NDS, which is being used as catalyst to prolong presence of US army in Afghanistan. The longer the presence of US Army in Afghanistan the more dollars would pour in the country.
It is unfortunate that this game is
being played at the cost of stability of Pakistan. The recent tweet of
President Trump leveling serious allegations of “lie and deceit” was nothing
but to divert the attention of the US citizens from the on-going investigation
against him regarding his alleged collusion with Russia to influence the
elections in America. He demanded Pakistan to do more once again whereas USA
had failed miserably to effectively fight against terrorism in the Middle East,
South Asia and particularly in Afghanistan. In fact, it is now the turn of USA
to do more to fulfill its part of commitment to the war on terror, which was
started by it and Pakistan supported it by laying lives of more than 70
thousand innocent causalities and putting its economy at stake.
The bias against Pakistan can further
well be judged from the recent unjustified and discriminatory announcement
whereby US has placed Pakistan on a “special watch” list for "severe
violations" of “religious freedom” allegedly consequent to the consistent
advocacy of the United States Commission on International Religious Freedom for
designating Pakistan as a CPC since 2002. It is strange that the Commission was
consistently advocating placing Pakistan on watch list but it took USA 16 years
to decide to announce this only when President Donald Trump termed Pakistan as
“deceitful and liar”. Pakistan has the right to ask as to who authorise USA to
a sovereign state on watch list and USA seemed to have assumed the role a monitor
against Pakistan.
Hold on dear President Donald Trump
and let me take you back to your own country to flag the performance of “great
America” in the field of “religious freedom”. The list of religious intolerance
in America is long which include increase of hate crimes against Middle Eastern
descents from 354 attacks in 2000 to 1501 attacks in 2001 after 9/11 attack;
more than 200 serious hate crimes against Arab Americans and American Muslims
after Oklahoma bombing; several attacks against Muslims after US Representative
Joe Walsh made a public statement in August 2017 against Muslims including acid
bomb attack on a Muslim School in Lombard, Illinois as well as hate graffiti in
a Muslim cemetery; attacks on mosques with pellet guns, acid bombs, eggs or unclean
animal parts; copies of Holy Quran were burnt by Terry Jones in the church;
burning of copies of Holy Quran by US soldiers in Afghanistan on February 20,
2012; killing of a 17-years old Virginia students by 22-year old Darwin
Martinez Torres with a metal baseball bat where the American media tried to
give it a colour of heated arguments about traffic, which led to the killing of
the girl; 57% increase in anti-Muslim bias incidents from 2015 to 2016 as per
the report of the Council on American-Islamic Affairs (CAIR) coupled with 44%
increase in anti-Muslim hate crimes in the same period; anti-Muslim and Islam
statements by Stephen Bannon and Sebastian Gorka; and last but not least the
interview of President Trump with Fox News in 2015 saying to “look at the idea
of closing mosques in the United States”.
Mr President Trump these above figures religious intolerance is from your country and where is this so called Commission on regions violation. Will you not call it as double standards? Before you talk about discrimination in Islam or religious intolerance in Muslims, you must know that the anti-Muslim rhetoric in your own country is nothing new. Although the United States is a nation that boasts religious freedom, yet the Muslims find it unsafe to practice Islam in it. Throughout the country, Muslim women retired their Hijabs and headdresses in fear of harm and men considered shaving their beards since the 9/11 attacks. Although some 60 Muslims were killed in the 9/11 attacks yet Muslims had received criminal threats against mosques; harassment in schools; and reports of violence targeting Muslim in your country.
Your administration while putting
Pakistan on a special watch list on “severe violations” of religious freedom
recently stated that: The government of Pakistan continues, "To perpetrate
and tolerate systematic, on-going, and egregious religious freedom violations
and religiously discriminatory constitutional provisions and legislation”. The
statement is based on heresy and bogus reports generated by some so-called
NGOs, which collects funds in the name of minorities and created religious
divides.
Mr president, before issuing
this-derogatory statement against Pakistan, someone from your administration
should have taken pain to read out the provisions of the Constitution of
Pakistan relating to the rights of minorities. However, for your information, I
would like to draw your attention to Article 20 of the Constitution of Pakistan
guaranteeing every citizen “the right to profess, practice and propagate his
religion” and “the right to establish, maintain and manage its religious
institutions”. Similarly, Article 36 places responsibility on the State to
“safeguard the legitimate rights and interests of minorities, including their
due representation in the federal and provincial services” including having
representation in the parliament.
It is, therefore, obvious that the
Constitution equally protects and safeguards the rights of the entire citizens
of Pakistan regardless of their religion, race, gender and ethnicity. By incorporating
Article 2A in the Constitution, the minorities of Pakistan were not only
protected as citizen of Pakistan but also their rights as minorities. It is,
therefore, inappropriate to suggest that Article 2A was in any way against the rights
of the minorities.
Now let me point out your
discrimination and your favour to your new friend PM Modi although he had deep
hatred towards Muslims and other non-Hindu minorities including Christians in
India.
India historically touts itself as a
secular state, which is true in theory but not in reality. According to a
report, out of 198 countries, India has been ranked as fourth worst in the world
for religious intolerance. Since 2015, many people across the country have
fallen victim to incidents of mob lynching related to religious intolerance,
which commonly resulted over petty issues. Recently, there has been a surge in
cases of public lynching by self-styled ‘gao rakshaks’ or ‘cow protectors’ in
different parts of the country over beef eating and cow smuggling or
slaughtering, being Muslims and Dalits among the victims but either the prime
minister or respective chief ministers have failed to protect Muslims and
Dalits from the attacks of extremist Hindus. Since April 2017, at least ten
Muslim men have been lynched or killed in public in suspected hate crimes, amid
a rising tide of Islam phobia in the country. Where is your commission and why
India has not been placed on special watch list by USA?
In June, a special court in Gujarat
convicted 24 people for their involvement in the mass killing of 69 people by a
Hindu mob in Gulberg Society, a Muslim neighbourhood in Ahmedabad, during the
2002 Gujarat riots. Peoples Union for Human Rights (PUHR), a human rights
organisation, which toured the riot affected areas of Gujarat and closely
examined the anti-Muslim riots there has published its report wherein it has
been stated that in the whole of Gujarat it was a one-sided violence against
Muslims wherein 500 mosques, ‘dargahs’ and ‘imam-baras’ were demolished and in
their places, religious places of the majority community were established. It
is further stated in the report that during the riots the state ministers, MLAs
and VHP leaders were sitting in the police control room and inciting and
directing the rioters against Muslims and that the state government is fully
responsible for anti-Muslim riots of Gujarat.
The Indian government’s continuing
failure to rein in militant groups, combined with inflammatory remarks made by
some BJP leaders, has contributed to the impression that leaders are
indifferent to growing intolerance. Why USA is continuously ignoring it.
Mr president, the way you have given
numerous statements against Muslims time and time again, do fall into the
category of your religious intolerance for Islam. Muslims face a visible
religious discrimination and bias in your country as a study that was conducted
back in 2015 revealed the facts about how Christianity is a dominant religion
in USA.
It is time for the public of USA to ask their government to revisit its geo political strategies and stop using religious divide as the key quotient in other countries. The world had previously witnessed how the religious divide was used in Iraq, which is still suffering because of this religious divide. And it is this religious divide, which has given emergence to a lethal terrorist outfit namely Daesh.
Pakistan is a country where all
religions are being freely practiced and hence one or two incidents cannot be
termed as the basis to put Pakistan on USA’s self-created watch list, ignoring
India for massive religious intolerance and including your own country where
religious violations is creating insecurity for non-Christian living in USA. We
Pakistani respect all religions but we will not tolerate any priest Terry Jones
like injurious statements or action against our Holy Prophet (PBUH) and Islam.
The world expects from USA to promote interfaith harmony worldwide and not the
religious divide, which it needs to put to an end.

Unjustified ‘special watch’ by USA for so-called violations of religious freedom by Senator A. Rehman Malik
Why no stringent law for false accusations? by Senator A. Rehman Malik
The introduction of social
media in the media industry has revolutionised the medium of communication
during the 21st century. However, it also attracted criticism from the wider
community for its abuse and misuse by certain individuals to fan hatred,
misinformation and intimidation of certain people. It also invited appreciation
from majority of people for its role in providing education and knowledge on
various social topics.
Certain people used it
with criminal intent, for spreading hatred and parochial sentiments and
religious division. Recently, law enforcement agencies unearthed different
pages on social media through which blasphemous material was being
disseminated, which ignited the sentiments of the majority of the people of the
country. Besides, social media has been used for character assassination of
different personalities through false and baseless accusations.
The Constitution of
Pakistan provides protection of all the citizen of Pakistan against all kinds
of discriminations regardless of their religion, ethnicity, gender and race.
Every citizen of Pakistan is “equal before the law and are entitled to equal
protection of law”, as provided under Article 25 of the Constitution. Article
10A of the Constitution is a safeguard for fair trial of any accused person.
However, social media in certain cases acted as accuser, prosecutor and the
judge while disseminating the allegations against a person on the social media.
In certain cases, these cases never landed in the courts because of the
unfounded and baseless allegations but till then the reputation of the accused
person had already been damaged beyond imagination. The unfortunate part of
this smear campaign on the social media had been such that the accuser(s) was
never brought to justice for the false accusation. Although Section 182 of PPC
provides for the punishment for levelling false allegations but the punishment
is not proportionate to the degree of the allegations, as the law states:
“Whoever gives to a public
servant any information which he knows or believes to be false with the
intention of causing such a public servant to do or omit anything which such
public servant ought not to do or omit or use the lawful power of such public
servant in order to injure or annoy any person, shall be punished with
imprisonment up to six months or with a fine up to Rs1,000/ or with both”.
It was the responsibility
of all the successive governments to enact laws and frame rules specifically to
deal appropriately with the growing trend of false allegations circulated on
the social media. The existing law only provides six months imprisonment of a
person who had levelled false allegations against a certain person which is in
no way proportionate to the severity of the damage done to the reputation of
the accused person and his family. Unfortunately, the lack of appropriate
punishment in the law for the person who brought false accusation against a
person encouraged the people to settle their own personal score against his
opponent through social media. There are quite good number of cases, which were
later proved to be based on false accusation but the accusers escaped the
punishment for one reason or the other. The most recent case of FIA on
cybercrime presented to the Senate overseeing committee shows that over 7000
complaints have been registered in the past but only less than 100 could be
converted into proper inquiry. Hon Justice Shaukat Siddiqui has rightly stated
that no single accused have been convicted according to prevailing laws.
The teachings of Islam as
well as the Constitution of Pakistan do not block the rights of its non-Muslim
citizens. The Constitution of Pakistan stands for equality of all citizens
irrespective of religion, caste, region, tribe, language and gender and it
guarantees the non-Muslims that their freedom to practice and follow their
respective religion shall be protected. Our law doesn’t permit any aspersion,
slightest insult and any kind of propaganda against our religion, either in printed
form or on newly emerged social media. Hence law has to be continued be
substantive, powerful and-flawless and Blasphemy-law which perfects and
protects any violation.
Recently, Justice Shaukat
Aziz Siddiqui, while hearing a writ petition for removal of blasphemous
material from the social media, has delivered a very detailed order, after
hearing the detailed and exhaustive arguments for and against the petition. In
the detailed order issued on August 11, 2017, Justice Shaukat Aziz Siddiqui has
expressed serious observations on the lack of implementation of law and also
observed the incapability of law enforcement agencies to deal with the
cybercrime in Pakistan and has recommended to the government of Pakistan the
necessary amendments into it. In his 116-pages detailed judgment, Justice
Shaukat Aziz Siddiqui has discussed in detail the common criticism of the
blasphemy law with remarks “Admittedly, not a single convict whether Muslim or
non-Muslim has ever been executed for blasphemy in Pakistan.” It has also
explained how innocent people owing to their personal animosity have been
victimised.
The judgment has also
observed that under the existing law, the false accuser can only face
proceedings under Section 182 of the Pakistan Penal Code (PPC) which entails
the maximum punishment of six months or a fine up to Rs1,000 only. “Currently,
there is a very minor punishment for falsely accusing someone of blasphemy,”
the judgment said. Indeed this is a very minor punishment for such a serious
offence of accusing someone of false allegations. In the said judgment, the
matter was referred to the legislature to amend the law for awarding the same
punishment for lodging a false complaint under the said law.
I believe, in the said
highly momentous judgment, Justice Shaukat Aziz Siddiqui has given a future
guideline for the parliamentarians to amend the law to make it more effectual
and particularly to stop its misuse for personal animosity, gains and
interests. This judgment has generated a discussion as to why should not be new
legislation only for those who make false accusations for their own ulterior
motives. Let this judgment be applicable on all the legislation including PPC,
special acts and tribunal to grip all those lodge fake FIRs and false
complaints under various special laws. This will deter all those who misuse law
for their own ends. This judgment if implemented in full letter and spirit
shall deter the false accusations.
Justice Siddiqui, in his
judgment, at the outset, built an argument about how the freedom of speech is a
responsibility, and not a right. As rights come with responsibility, he quoted
the declaration of rights of the French Revolution, among other historic
documents in his judgment which says: “The free communication of ideas and opinion
is one of the most precious of the rights of man. Every citizen may,
accordingly, speak, write, and print with freedom, but shall be responsible for
such abuses of this freedom as shall be defined by law.” Along with this, Hon.
Justice also quoted the Article 20 of our constitution which clearly states:
Any advocacy of national,
racial or religious hatred that constitutes incitement to discrimination,
hostility or violence shall be prohibited by law. In view of this timely and
historic judgment of Islamabad High Court, the government should immediately
move for necessary amendments for enhancing the punishment for the person who
make false allegations against anyone by amending the relevant law to punish
the accused who lodge the complaint. Let the main substantive law to remain
unchanged and let a law as proposed above be enacted at the earliest in the
interest of fair justice.
Levelling false
allegations are strictly prohibited and strongly disliked in Islam and as true
Muslims we should refrain from levelling false accusation on any individual.
Allah the Most Merciful says in Quran, “And whoever commits a fault or a sin,
then accuses of it one innocent, he indeed takes upon himself the burden of a
calumny and a manifest sin.”
Now, it is the duty of
parliamentarians as a whole, and particularly the government to move for the
essential and prerequisite amendments into the law. The government should place
this matter before CII and the Law Division should propose the requisite
amendments as per the judgment of Islamabad High court. Let this be deliberated
in the Parliament to have the collective wisdom and national ownership to avoid
any blame game.
In the end I would like
appreciate Justice Shaukat Siddiqui Islamabad High Court for showing great
wisdom in deciding this difficult issue in the greater national interest. I as
chairman Standing Committee Interior have taken this matter/judgment in the
committee during the briefing of National Action plan and directed the
ministries of Law and Interior to propose a draft bill we invite all the high
court bars as well to contribute in drafting this to block the misuse of our
law.

Our Zainab - Looking for Justice by Senator A. Rehman Malik
We all parents are worried and sad to
see the killing of our daughter Zainab . This incident has diluted our faith in
our system and we feel sorry that we are living in a society where some do not
have human ethics and no respect for human beings. Innocent Zainab lost her
life to a merciless “darinda” who killed her for his lust. While committing
this heinous crime he had neither fear of God nor of the law of the Land.
The law of the land protects its citizen with the power of fear of action through the force of law; but it seems that law of the land is there but force of law has severally diluted, allowing the criminals to commit worst types of crime without fear. This fear of law stands diluted as the criminals while committing a crime consider themselves to be above the law and feel confident that they will manage to get out of it with the force of their political backing or by influence of their money. Moreover, the conversions of police complaints into cases are not very encouraging and there is hardly a real time conviction and hence there is no deterrent through the force of law.
The data of last few years indicates
alarming number of child sex abuse incidents followed by death of several
children who were later dumped on the streets and garage piles. The statistics
deeply trouble a sane mind and it is so unfortunate to see that these are the
circumstances of our beloved country Pakistan.
According to the statistics of a
nongovernmental organization a 10% increase in the cases of child abuse is
observed in 2017; on average 11 cases of sexual assault against children happen
every day. According to the report in the year 2016, almost 100 children were
murdered after sexual abuse, while 2410 girls and 1729 boys were sexually
abused, making the total number of victims to be 4139. Among major crimes
against children reported cases for abduction were 1445, for child rape were
502 and for attempted sexual abuse were 362 cases. The highest number of cases
of sexual abuse against children was reported in the province of Punjab, with
2676 cases alone in 2016.
The report also revealed a 19% increase
in the abduction cases of children; in 2016, 1654 cases of abduction were
reported, whereas in 2015 the rate of abduction crimes was lower, with 1386
cases of abduction all over Pakistan. Owing to the rise in crimes the number of
children abducted is reached to 5 per day. In the year 2016, 78% of total cases
of sexual assault were reported with the police, while police did file an FIR
for 142 cases. For several years Kasur has been a sanctuary for the criminals
and a torture cell for its residents, 720 cases of child abuse in Kasur,
similar in nature as to the incident of Zainab have been reported in the last
three years alone. In 2015 sexual child abuse photography case was brought to
light by the media, and it appeared that a decade long organized crime in Kasur
had become a norm, owing to the delay in justice and untimely force of law
despite many complaints by the residents, just because the criminals had
political backing. 280 children were victimized in this mega child abuse
organized crime and 400 sex videos of these children were made by force by a
group 25 criminals.
The police was made aware about these
incidents by the families time and again, that boys and girls under the age of
15 were raped and filmed to generate money from selling these sex tapes,
nationally and abroad. However no timely and substantial action was taken
against these criminals for years, why? When the issue became too big to keep
quiet the police made it a case of property dispute, while parents of the
victimized children were blackmailed either with the help of police or right
under their noses by these criminals to pay heavy sums, as the threat of the
sex tapes of their children being released in public hung over their heads.
Kasur incidents draw a clear picture of how our moral values and enforcement of
law has deteriorated. It also shows the failure of our political and religious
leadership and of the law enforcement agencies.
The Law again failed to provide
justice to the people of Kasur, as Zainab’s case is the 12th of its very
nature. In the last 12 months 12 other innocent girls, between the ages of five
to eight have been the victims of similar hideous crimes, where they were
kidnaped, raped and killed. The other cases were handled poorly by the police
of Kasur. Although the six samples of the victims sent for forensics proved
that all six girls were raped and killed by the same person, the system failed
to catch the culprit.
Reports also suggest that the claim
of the police to catch and kill the suspect involved in the crimes against
these girls was hallow and fake. Had the incident of innocent Zainab’s murder
not been highlighted in the media and had the people of Kasur not stood up
against the criminal wave hoovering over their city, it would have been yet
another case buried in the pile of hundreds others. The question here is, what
is reason behind the delay in justice ? Many protests erupted after these
rapidly occurring incidents, and despite the assurances of the law enforcement
officials, the key culprit is not behind bars and still is a threat to the
society.
Why our laws have failed to create a
deterrent for criminals and violators? Why the father of young Zainab blames
the system for the death of his beloved daughter? Can we stop any other Zainab
becoming a victim? These are all important questions that all of us should ask
and seek the answers for, because the diluted strength of law is felt at all
levels and in laws. Basically “rule of law” has been undermined and it has been
politicised and the “rule of law “ should have been there to use a stick for
better governance and protection and safety of citizen but here law is made for
the rulers to rule with impunity.
The killing of Zainab has not only left the entire nation sad but also has shaken our conscience. She is asking for Justice from all of us. The poor little girl must have cried and begged for her honour and life but the criminal dared to commit this crime fearlessly and shamelessly. We can only stop another Zainabs from becoming yet another victim of these paedophiles if we decide to have rule of law. The present law on child abuse with new added sections like 292A, 292B, 292C, 328A, 377A and B to the PPC 1860 prevents exposure of a child to seduction and creation of child pornography and these acts are punishable by law. But the question remains that despite the laws to regulate societal behaviour, what is our law enforcement agencies like Police doing to stop these filthy criminal?

Obama, Bush vs President Donald Trump and his illusions against Pakistan by Senator A. Rehman Malik
Mr Donald Trump is bashing Pakistan from day one of him into the White House and now most recently in his tweet he has tried to give a negative angle to Coalition Support Fund (CSF) to divert the attention of the American people from and particularly his opponents to divert their attention from Russian leaks and to advance his geo-political agenda in South Asia. By discrediting Pakistan, actually he wants to pave his way to create so-called justification to violate the sovereignty of Pakistan.
In other word other, Mr Donald Trump is paving his way for some kind adverse action against Pakistan to destabilise this region including China to push the world nearer to third world war. Such irresponsible statements are certainly neither in the favour of America and its people and nor will it strengthen allies’ efforts against terrorism.
After 9/11, Pakistan and USA had agreed on the procedure of provision of CSF. Coalition Support Funds (CSF) refers to money from the Defence Emergency Response Fund (DERF) that is eligible to be used to reimburse coalition partners for logistical and military support to US military operations. Initially created by the Defence Appropriations Act for FY-2002, the law permitted DERF money to be available for payments to Pakistan and for logistical and military support provided to US military operations related to Operation Enduring Freedom in Afghanistan. These payments were authorised to be made as per the actual claim of Pakistan and to be determined as appropriate by the Secretary of Defence with documentation deemed adequate by the Secretary. Prior to any allocation of funds, the Defence Department was required to notify Congress at least 15 days in advance. The application of this procedure was made applicable to Israel, Egypt, Afghanistan and Jordan in addition to Pakistan.
The abrupt statement of President Donald Trump has shocked every Pakistani wherein he states that the United States has foolishly given Pakistan more than 33 billion dollars in aid over the last 15 years. President Donald Trump needs to see the procedure and the agreement made between Pakistan and USA after the heartbreaking attack of 9/11 in 2001. This CSF was subject to the clearance of security, defense and concerned Congress Committee and obliviously under the governance of President George Walker Bush who served the United States from 2001 to 2009 and Mr Barak Hussein Obama who served as president from 2009 to 2017 during their respective tenure under question by President Donald Trump.
In other words while bashing Pakistan, President Donald Trump in fact has doubted and discredited the two elected presidents of USA to have done reimbursement foolishly. The word “foolishly” has been used for his two political opponents i.e. Mr Bush and Mr Obama and Ms. Hillary Clinton who served US as Secretary of State from 2009 to 2013, and the Democratic Party's nominee for president of the United States in the 2016 and also the other two US Secretary States Ms. Condoleezza Rice (2005 to 2009) and Mr. John Kerry (2013 to 2017).
President Donald Trump has tried to kill two birds with one stone; one to pressurise Pakistan and the second to prey his opponents as currently he is under the pressure from the Russian leaks being investigated by Mr Robert Mueller former Director The Federal Bureau of Investigation (FBI). As the inquiry is progressing against him and his close aides and some of them have already resigned from senior positions including General Michael Flynn who resigned as Donald Trump's national security adviser after weeks of speculation over his links to Russia as for first he denied his contact with Russians but later the availed evidence forced him to confess and resign.
Where Pakistan is continuously under his threats and I had written two articles earlier under the title of “Do more Pakistan’ syndromes of USA” published in ‘The News’ on August 15, 2017 and “The Trump Threat” published by ‘The Nation’ on August 24, 2017 and also an open letter to President Donald Trump on the next day on August 25, 2017. In the said letter and two articles I had advised President Donald Trump to please take along the entire Muslim community to fight against few terrorists and you will have full support of Muslims against terrorists. I had emphasised that your threat to the Pakistani nation had been viewed as a callous as Pakistan was expecting that you will treat Pakistan as victim of war and would appreciate its sacrifices in the war on terror. Despite threats from eastern borders, Pakistan has focused its resources both in terms of personnel and financial, on fighting against terrorists inside Pakistan and along Pak-Afghan border. The claim that US has provided billions of dollars to Pakistan has been made out of context as it was never been financial aid but payment against services provided by Pakistan to US and Nato Forces.
In fact USA failed to chalk out a Common strategy to fight against our common enemy destroying the peace of the world. Pakistan also must not ignore Mr Donald Trump leaning towards India as there is a close correlation between the unparliamentarily statements of Mr Donald Trump and PM Narendra Modi against Pakistan.
Apparently, it looks that Donald Trump is under terrible pressure from the ongoing inquiry and the Russian leaks which were used to influence the election damaging Ms. Hillary Clinton in presidential elections. The recent statement of Donald Trump calling the decisions makers as foolish is in fact reinforcement of his statements used during his election campaign against Ms. Hillary Clinton and two former presidents and almost the entire past US administration.
The second part of his tweet reads “They (Pakistan) have given us nothing but lies and deceit, thinking of our leaders as fools.” He has leveled the allegation of “lies and deceit” on Pakistan and has linked his allegations to his own American leadership as ‘fool’ and intact he has called the leadership of USA as abettors.
In fact, Mr Donald Trump has violated his own Constitution by suspecting his own country’s legal and administrative system dealing with such disbursement including the American enactment under Kerry-Luger Bill duly passed by American Congress?
Finally he says that “They (Pakistan) give safe haven to the terrorists we hunt in Afghanistan” which shows that he is absolutely misinformed as no country has done and suffered in war against terrorism and still it continues. It is serious war and not a scene of Red Indian movie in which hunter on his horse is seen hunting in Mexico as terrorists have become bigger hunters who are hunting worldwide using terror as their weapon.
I feel President Donald Trump needs a detailed briefing on ‘War on Terror’ and including how USA has fooled Pakistan not for once but time and again. Firstly by manipulating PAF Camp Badaber from July 17, 1959 until January 7, 1970 which was used by USA against Russia and for second time Pakistan was lured by US against Russia in Afghan war and thirdly US used our air, sea and land after 9/11 and still using Pakistan logistics. Sadly, instead to be grateful to Pakistan for its unmatched services and numerous sacrifices, President Donald Trump is bashing Pakistan. No country but Pakistan has received 75000 casualties of its civilians and troops with economic loss of $188 billion and huge devastation to its infrastructure. Pakistan has the right to claim the loss because of commercial airspace closure. President Donald Trump should realise that his precedes were not fool but intelligent however he used Russia against his opponents while the precedes successfully disintegrated the Soviet Union using the soil of Afghanistan.
I had close interaction with your three former presidents and three former Secretary States and had found them stable and with political wisdom who protected American interests well. I would like to advise you to have a detailed meeting with former leadership of USA who closely dealt with War on Terror before you repeat to make any such abrupt move against Pakistan.
Pakistan’s survival is certainly not dependent on US aid as Pakistan has suffered more than you can offer in compensation. Though you have confessed little help from Pakistan and please do quantify the said admitted help. Being the president highly influential country and super power, Mr Donald Trump should drive the world towards peace rather war as for own political scoring and diverting public attentions such statements never suits him.
“Our help as little help”, No more”, can you return back all those who lost their lives in war on terror to their dear ones?
I propose you to visit Pakistan and meet those families who have lost their dear ones in this war on terror which was imposed in the region by US. I appreciate Ms. Hillary Clinton who had visited some of these families and showed her solidarity with them and had felt their pain.
Mr President Donald Trump, one cannot improve upon failures, till one accepts the reality. And the reality is, stated by US top military officials, the US is not winning war in Afghanistan. Externalising this failure on Pakistan will not work, US’ policy makers need retro section, and reinforcement of failure is never a good strategy. Pakistan as a friendly gesture is ready to go back on the drawing board with regional stockholders and assist US in Afghanistan.
Beware of the fact that if any attempt is made to destabilise Pakistan then it’s us not going to restrict to this region but engulf the whole world including USA.
Mr President please march with the world towards peace and not to drag the world into war as wars always bring miseries and USA still have the touch of Vietnam war and graveyards in Washington still witness the tears of the families who lost their dear ones who lost their lives in this pointless war.
Let us work for peace and not for war.
