Continuity of COAS is in national interest by Senator A. Rehman Malik

Today’s condition of our colourful TV channels reminded me of the trial of OJ Simpson in USA where the all of America was glued to their TV just like the way we were today. I could see how some of our media houses were not even bothered about the national security yet some unconcerned people were giving views detrimental to the interest of the country.

All that is happening since last two days was not in good taste though it exposed the incompetency of some important members of this government hence I decided to pick my laptop and started to express my views. It is constitutional right of the PM to grant extension to the Army Chief and he was within his legal right to recommend to the President for re-employment of Gen Qamar Javed Bajwa for next three years.

It was accordingly approved and was notified with some visible errors because of the incompetency of some members who brought big embarrassment for the government in the court and media.

This is a topic which I will take up sometimes later to identify the careless and non-professional conduct in handling this important matter. I hope PM will be able to identify if this undesirable attitude dealing this matter was deliberate or it was usual incompetency.

I tweeted about the powers of the PM and the Mr Aitzaz Ahsan has also opined the same that it was legal right of the PM to give extension and majority of the legal fraternity has also endorsed it.

I have served my country in different capacities including in the capacity of Interior Minister and I know it fully well that sometimes nether the government nor security institution can make few matters public in the national interest due to high security risks. I recall when our government gave extension of three years to Gen. Kayani and we genuinely felt that the continuity of Gen Ashfaq Pervez Kiyani was in the national interest, hence we followed the constitution and the extension was given without any noise. I personally feel that Gen Ashfaq Pervez Kiyani was a competent General and I am witness to his professionalism and his services for his institution. There had been two other such extensions in service in the past where Gen. Zia ul Haq gave four extensions to himself being the President at the same time and ruled for 12 years. Similarly, Gen. Pervez Musharraf had given three extensions to himself as COAS while also being the President of the country. He ruled the country as President for nine years. The extension in service to Gen. Bajwa, was, therefore, not the first and the only one in the history of Pakistan.

I wish the PM had asked his staff to have replicated our course of action observed by PM Yousaf Reza Gilani and he would have not experienced these odd moments today. I in my personal capacity feel that country is going through number of challenges including the LOC violations and the worsening situation of Kashmir where India is on war with our Kashmiri brothers and sisters and basically it is war against Pakistan. Afghanistan is daily playing dirty and I can prove to the nation that we are already on war with India which has already initiated 5th generation war which is being fought well through well through Bajwa war doctrine and we need him to continue to counter India with his way and capability.

I support the extension of Gen Bajwa due to some additional following reasons.He controlled the terrorism in the country especially after APS attack and came hard on the terrorists in the tribal areas and we have now peace there.Pakistan used to be under the influence of USA, and he is the first Army chief who has weeded out the American interference in our domestic politics and other affairs & I salute him for saying No to the American influence and extended hand of defence cooperation on equal footings. He refused to succumb to the pressure of Afghanistan and his western associates and ensured fencing on the Pak-Afghan border.He did the best shuttle diplomacy between Iran and Saudi Arabia and according to my personal information, he will be able to get both the countries on friendly terms which is a great service to the Muslim Ummah. He has worked out strategic plan for Defence of Pakistan against any aggression from India through his Bajwa doctrine.

If we examine with all fairness the role of General Bajwa then an extension in his service as COAS is well deserved and merit recognition of his services to the national security. He is much more competent chief with extra ordinary professional qualities and services to the country.

It is important for the government to read between the lines the remarks of the honourable Supreme Court which has very politely pointed about the mistakes committed by the government functionaries. I tweeted my proposals today and based on my experience I propose as under in view of the advisory remarks by the court and the government should proceed as under to overcome this crisis. In a way the Supreme Court has given a chance to the government to rectify it. A fresh summery to be initiated by the Ministry of Defence to PM via the law ministry and ensure flawless summery with brief justification for the extension in service as COAS with the achievements etc. The same summery of extension may be got approved by hand by all concerned.

A draft Notification based on the approval of the President be made in suppression of the previous notification and place it before the Honorable Supreme Court today in the morning with the prayer for the cancellation of the earlier suspension orders of the Notification enabling the government to issue this new notification, prepared in the light of the remarks of the Supreme court.

I hope and pray that this matter is resolved today with a good future lesson to the governments & its functionaries to follow the law & the given procedures.

Well-Done Gambia; it's Modi's turn now by Senator A. Rehman Malik

I feel so proud of the Gambia, a small Muslim country at the world map. The country has made the entire Muslim community proud of its action by making Aung San Suu Kyi face the first legal action over the Rohingya genocide. I hope the International Court of Justice will indict the Indian Prime Minister Narendra Modi as a war criminal for his unprecedented crimes against humanity in Gujrat and Kashmir one day.

This tiny African country has taken the case of oppressed Rohingyan Muslims to the world court who were butchered like Kashmiris and buried in mass graves. It has filed a complaint in the form of a lawsuit at the top court of the United Nations formally levelling the charges of genocide against Myanmar. I gave the same suggestion to the present government. I asked the government to move a petition against Prime Minister Narendra Modi to drag him as a war criminal for his crimes against humanity in Kashmir. Nevertheless, I was disappointed to see that the government of Pakistan has taken no action so far.

The ruler of Gambia, which is 7000 miles away from the Rohingya, felt the pain of his Rohingya Muslims. He came forward to rescue them by knocking the door of international court against those who are responsible for mass genocide of Rohingya Muslims. Whereas, our rulers few kilometres away from Indian Occupied Kashmir could not show the courage to make such a move.

It is unfortunate that none from the Muslim Ummah, including my own country Pakistan, could take any initiative against India’s latest belligerence. Though I suggested to the government to use this option many a time on the assembly floor, but to no avail. Subsequently, on Sept. 26, 2019, I penned a letter to Prime Minister Imran Khan urging him to take the Kashmir case to the International Criminal Court (ICC). In the letter, I had noted the procedure for referring the case to ICC under the Rome Statute. It reads, “Any individual, group or state can send information to the OTP regarding alleged crimes falling under the jurisdiction of the court. To date, the OTP has received more than 12,000 of such communications, which can form the initial basis of the Office’s preliminary examinations. The OTP conducts a preliminary examination to decide whether there is a reasonable basis to initiate an investigation.”

Moreover, in the said letter to the Prime Minister Imran Khan, I had clearly stated “I would like to invite your attention to the only option left for Pakistan and Kashmir to move the matter to the International Criminal Court (ICC) under the Rome Statute where in the oppressed Kashmiri victims through the representatives in Azad Kashmir and other parts of the world would come forward to file this petition in ICC to drag PM Modi as War criminal and you have very rightly stated that PM Modi is a war criminal. I have already advocated my point of view in the Senate Standing Committee for Foreign Affairs in the presence of our Foreign Minister and meeting with Foreign Secretary Foreign Affairs.”

In another letter to Foreign Minister Shah Mahmood Qureshi on Oct. 19, 2019, I again urged him to take the case of continuous unprovoked ceasefire violation and targeting of the civilian population by India to the United Nations General Assembly and International Court of Justice. Apart from this, on Sept. 16, 2019, I moved a resolution in Senate Standing Committee on Kashmir Affairs and Gilgit-Baltistan which was unanimously passed. I demanded to take Prime Minister Narendra Modi as a war criminal to the International Criminal Court under the Rome Statute. I informed the audience that the Kashmiri leaders as “direct victims” can file a petition for this trial, according to the Rome Statute. The Senate Standing Committee on Interior has passed dozen of resolutions demanding the government to file a petition against Indian Prime Minister Narendra Modi in ICC and ICJ. Despite all efforts to approach ICJ and ICC, sadly no action has been initiated by the government till today.

The Gambian Minister of Justice and Attorney General Mr Abubacarr Marie Tambadou picked the courage. They presented the case before the UN quoting one of its reports compiled with graphic details as to how army troops brutally conducted a crackdown. They presented evidence of how the heartless Buddhist-majority of Myanmar killed thousands of Rohingyan while the women were raped and properties destroyed in 2017. This forced more than 800,000 Rohingyan to take refuge in Bangladesh and some other neighbouring countries. Mr Ba Tambadou visited a Rohingya refugee camp in Bangladesh in May 2018 and interviewed many displaced families. The research with many untold stories compelled him to take a stand against this brutality.

It is a fact that Indian troops under PM Modi replicate the same model of genocide and brutalities in Kashmir which were done by Myanmar’s heartless soldiers against Rohingyan Muslims. Indian Army is busy committing the same war crimes against oppressed Kashmiris in terms of mass murdering, mass graving, mass blinding through pelleting, rapes, tortures, enforced disappearances, political repression and locking down of the whole valley through brutal curfew. The resemblance in the modus operandi of both oppressors is uncanny. It was shocking to see the visit of PM Narendra Modi to show his solidarity to Myanmar during the days of genocide there. And we heard not a single word of sympathy for Rohingya Muslims.

The actions of both armies – that of India and Myanmar – are nothing but “Crimes against Humanity” speaking in the jargon of international law. I hope the United States will describe the actions of the Indian army as “Ethnic Cleansing” the way the USA described the excesses of Myanmar troops as “Crimes against Humanity.” Modi should also face similar charges what Myanmar is to face over the allegations of genocide in ICJ and ICC. It is for the first time that the court in Hague has also investigated genocide claims on its own without relying on the findings of other tribunals like Bosnia commission. The ICJ clearly states, “the application argues, member states can bring actions against other member states over disputes alleging breaches of international law.” The Gambia has invoked the 1948 convention on the prevention and punishment of the crime of genocide in this matter.

Therefore, Pakistan also needs to do the same even Pakistan is not a signatory to Rome convention. Myanmar being not the signatory has been roped in the investigation for trial. Hence, India will not be able to refuse inquiries given the precedent set with the initiative of The Gambia. I appeal before other Muslim countries to support The Gambia in this noble cause and endorse the actions of Gambia through their respective legal teams by showing their presence on the first hearing of the case in December this year. I propose that Prime Minister Imran Khan should also direct his Ministries of Law and Justice and Foreign Affairs to become a party in this matter before ICJ. The state should let the Attorney General of Pakistan be present in the hearing, as this is a God-given opportunity to help directly and indirectly to the oppressed Kashmiris.

The vice-president of the Gambia, Isatou Touray describes her state as “a small country with a big voice on matters of human rights.” Indeed The Gambia with a big voice stands taller than any other Muslim country and all the so-called champions of human rights. Indian troops started “Muslim Cleansing Operations” by imposing a curfew on Aug. 5, 2019, first to keep the entire acts of brutalities as secret. The soldiers are systematically killing the Kashmiris through forced disappearances, rapes, gang-rapes, sexual assaults, detentions, torture on Kashmiris and destruction of their houses, mosques, madrassas and shops. These Human Rights Violations include gang rapes and mass disappearances of approximately 8,000 to 10,000 people by the Indian military. Also, as many as 100,000 Kashmiris have been killed and several thousand wounded and blinded through torture tactics in custody.

While over 70,000 Kashmiris have been killed by the Indian forces in the last three decades, nearly 24,000 Rohingya Muslims have been killed by the Myanmar state forces since August 15th, 2017. More than 34,000 Rohingya were burnt alive and over 18,000 Rohingya women and girls were raped. The figures showing brutalities against the Kashmiris are more or less the same as of Rohingya Muslims hence, ICJ should not ignore the genocide in Indian Occupied Kashmir (IOK). The international court of justice is the ultimate authority to act against the violation of “Genocide Convention”.

I hope these two International courts, the ICJ and the ICC, will take cognizance and demonstrate full responsibility. I hope they will come up to the expectations of the oppressed communities in the world, especially the Kashmiris who are facing the brutalities of Modi Government in Kashmir. The world community needs to raise their voices against the crimes being committed by the Indian Army against in Kashmir just like the representatives of The Gambia which couldn’t remain silent on genocide of Muslims in Myanmar.

It is encouraging to note that the prosecutor of the International Criminal Court (ICC) under Rome Convention has already opened a preliminary investigation of Myanmar Genocide, though Myanmar is not even a signatory to the Rome convention. Let us hope that the ICC also orders a similar investigation against India in the near future. I hope the government of Pakistan takes the Kashmir case to ICJ and ICC on humanitarian grounds, based on the pieces of evidence I have provided to the Ministry of Foreign Affairs. I do not find any reason for the government to delay moving against the Indian PM Narendra Modi for his war crimes against humanity. I also propose to the government to invite Mr Abubacarr Marie Tambadou, the Gambian Minister of Justice to Pakistan to award him with the highest civil award of Pakistan.

FATF Bombshell via USA Country Report by Senator A. Rehman Malik

The most recent USA country report is basically another bombshell to be used in FATF against Pakistan whereas it should have not issued such a biased report when there’s already a proceeding going on against Pakistan in FATF. We have been exploited by USA every time that we stand in this worst situation at this point of history. We made a blunder to jump into Afghan Jihad War against Soviet Union upon USA’s call. This gulped down our all factions of society because of the strong pro Jihad propaganda by USA. I got a chance to meet these Jihadis from Pakistan and all over the world when I was travelling undercover through Afghanistan and passed through rugged mountains during the war of Afghan Taliban vs Northern Alliance. I noticed there young and old Pakistanis waiting to go to fight on advance positions. Although they were not even familiar with the modern weapons and technology, but they were motivated enough to get killed come what may as per their brain washing.

It was the USA which converted their immature mindsets into Jehadi mentality in order to use them against Soviet Union. Now the same Jihadis are running some of the Madrassas that preach nothing violence against humanity which is contrary to the principles of Islam. This Jihadism was America’s own creation because of which, we are suffering today. Unfortunately, today we are dragged in the FATF because as per America's will, we extended support to these Jihadis who have now turned into monsters post Afghan war.

It is merely an injustice to Pakistan for being dragged before FATF like a criminal whereas in actuality, it was President Bush who should have been facing trial as war criminal for the creation of Jihadists and mass killing in Afghanistan. Hence, I had been persistently advocating to the government and to the world that USA will not let Pakistan come out of the FATF’S grey list and will continue to pressurise FATF to keep Pakistan in the grey list. This latest country report by the USA will also be now placed before FATF as yet another fake evidence. We are only being punished by the USA because of our friendship with China, Pak China corridors & our stance against India under RSS.

We are also suffering because of the failure of Afghan-US dialogue which is wrongly attributed towards us as we want to see peaceful Afghanistan for which Pakistan is extending its full support to the USA in their dialogue between USA and Afghan Taliban. The US State Department’s Country Report on Terrorism 2018 has come up with disappointment for Pakistan as it is highly biased and illogical wherein the real situation on the ground and the supreme sacrifices of Pakistani troops and civilians rendered in war against terrorism are absolutely ignored. Despite of the apparent cordial meeting between US Donald Trump and Prime Minster Imran Khan on the United Nations General Assembly forum, Pakistan was expecting better and improved relations with USA whereas USA released an anti-Pak report instead which has come up as a shocking development for every Pakistani.

A large number of Pakistanis feel that PM Modi was not courageous enough to change the status of Kashmir against the UN resolution but within days of his return from the White House, USA he scraped the legal status of Kashmir whereas we find no particular efforts from USA Govt to force India to lift curfew by restoring the original legal status of IOK. Basically, we have now become the victim of 5th generation warfare and the major factor is economy which is being hit through FATF to cripple our Economic growth as I strongly believe that FATF drama has been engineered only to cripple our growing economy & to block our overseas investments.

In reality, the steady growth of economy is being further crippled by FATF & IMF and this Economic destabilisation is only due to the fact that we always bow before the IMF which is successfully ensuring to add more burden on common people of our country with non-stop price hike and consecutive increase in prices of Petroleum products. I am stating it on record that India will continue to feed USA negatively on Pak on fabricated plots, and Pakistan will continue to face the negative hammering from White House and the demand of do more syndrome will never come to end.

The people of Pakistan has the right to ask the USA administration as to why has the USA turned blind eye towards the brutalities and religious extremist acts of Indian ruling party BJP’s extremist wing RSS under PM Modi which is involved in terrorist activities against minorities across India particularly Kashmir.

The US State Department recent Report clearly indicates that it is an anti-Pakistan move by US to please India. The report states “Pakistan did not take sufficient action against externally focused groups such as Lashkar-e-Taiba (LeT) and Jaish-e-Mohammad (JeM), which continued to operate, train, organise, and fundraise in Pakistan.

The Pakistani government pledged support for political reconciliation between the Afghan government and the Afghan Taliban but did not restrict the Afghan Taliban and HQN from operating in Pakistan and threatening US and Afghan forces in Afghanistan. This is factually wrong as these two networks are also the byproducts of Afghan war, including HQN and were nourished by American funding spent in Afghan -war. These two Pak networks were banned by me as Interior Minister. In June 2018, the FATF placed Pakistan on its list of jurisdictions with strategic deficiencies (the “grey list”) for deficiencies in its AML/CFT regimes, including the failure to implement UN sanctions related to designated entities.” The careful examination of the above allegations shows that the allegations are nothing but an attempt to re-enforce the old blame & replication of demand of USA “to do more”.

I, in my article ‘Do more Pakistan’ syndromes of USA on August 20, 2017, stated that do more syndrome by President Donald Trump is not going to stop this demand as there is continuity of re-enforcement of negativity against Pakistan by India in the White House and other allied institutions of USA. These organisation in question earlier fought against Russia with the total financial and armed support of USA.

In fact, US itself was responsible for the creation& funding of all these Jihadi organisations in Pakistan and US owes an explanation to the world as to how and from where these jihadi organisations were supported and financed with full money trail.

Can USA present the money trail of wars in Afghanistan, Iraq, Syria, Cuba and many others countries CIA dirty operation before questioning Pakistan in FATF? Will the American White House make the details of the meeting between William J. Casey Director CIA, Gen Ziaul Haq and Gen Akhter Abdur Rehman public which was held before launching Afghan war at a secret location? Also what mode of funding was created to finance Afghan war and who were the ones who got benefited from Afghan - Jihad dollars via a beach city of France namely Marseille? The track of Afghan Jihad money will lead the investigators directly to Switzerland and many from USA & Pakistan will be in great trouble.

Will USA unveil the details of expenditure of these wars in supporting jihadists as well as the creation of these organisations, including Haqqani network and other splinter groups, including Northern alliance during and after Afghan war? I am sure Victor Bout a famous Russian low flying captain will speak one day after his release from USA jail as to who was his master that made him drop the arms in Afghanistan and many other war ridden countries in Africa. I will write on it later sometimes. I really feel bad that USA used Pakistan in war on terror and now it is punishing us at this point of time which is not understandable.

The then Secretory State Hillary Clinton had already accepted that USA funded Taliban and even Al-Qaeda. I am sure that the government of Pakistan will ask FATF to summon the former Secretaries of State and the then former US Presidents to justify and confirm the authenticity of the statement carried out by the two secretary of states. The president ordering war through Jihadists in Afghanistan against Russia needs to justify as to what means were used to finance these Jihadists in Afghanistan.

The US State Department’s Country Report on Terrorism 2018 is contrary to the facts in which the real situation on the ground and the supreme sacrifices of Pakistani troops and civilians rendered in war against terrorism are ignored. As a matter of fact, no country had done more than Pakistan to curb terrorism and no country had suffered as much as Pakistan, both in terms of loss of human lives and damage to infrastructure, in the war against terrorism and extremism. Pakistani Forces in daring operations against terrorism have uprooted al-Qaeda and other terrorist organisations from the country and have successfully dismantled terrorist network which are being supported by neighbouring countries to create instability in Pakistan.

Along with sacrifices of more than 70,000 of its troops and civilians, Pakistan has been taking numerous legal and administrative measures against terrorism and all parties above their political differences sat together and formulated National Action Plan (NAP) to curb terrorism from its roots. US should well realise that rather Pakistan, India is a hub of terrorists and has been sending its terrorist to Pakistan which is evident from the arrest of Kulbhushan Yadav who is still in the custody of Pakistan.

He had confessed that he was RAW operator since 2013 end and ever since he has been directing various activities in Balochistan and Karachi at the behest of RAW and deteriorating law and order situation in Karachi, Pakistan. This is no secret that India’s Intelligence Agency Research and Analysis Wing (RAW) is working in collaboration with the Afghanistan’s Intelligence Agency, National Directorate of Security (NDS), for creating instability and hostility in Balochistan and Fata, yet no action against India has been initiated by US and United Nations. US, the international community and particularly the Financial Action Task Force not to fall prey to Indian propaganda against Pakistan.

The trend and the anti-Pakistan signals demonstrated in the report clearly show that FATF is not going to take Pakistan out of the grey list unless Pakistan embarrass FATF in its discrimination with Pakistan and Pakistan will have to do this for its survival in the economic world.

The continuity of Pakistan in grey list will bring huge financial problems for Pakistan which is already passing through financial crisis. I hope the Government of Pakistan will take some sensible, pragmatic and evidence based measures before the FATF with the help of China which has already warned member countries not to politicise FATF and not use the forum against Pakistan. China has clearly stated, “China does not want the FATF to be politicised by any single country. There are some countries which want to include Pakistan in the blacklist as they have political designs with ulterior motives against Pakistan.

Kangaroo Court vs Babri Mosque by Senator A. Rehman Malik

The historically and archaeologically very important mosque the Babri Masjid was constructed on a vacant land some 493 years back in 1528-29 by Muslims which continued to exist as a place of worship for Indian Muslims. The Indian Hindu extremist organizations conspired to construct temple replacing the Babri Mosque and RSS took this unholy task to demolish it. According to investigation the handler of Samjhauta express and demolishing of Babri Masjid were the same duly back by RSS. The Indian Supreme Court under the fear of RSS gave highly controversial verdict after admitting the act of demolishing Babri Masjid which was illegal and yet the verdict was announced in favour of those who demolished it. Here is a are four salient features of the Supreme Court of India’s foul verdict as under:

Given all the evidence presented, it had determined that the disputed land should be given to Hindus for a temple to Lord Ram.

Muslims would be given land elsewhere to construct a mosque.

Federal government to set up a trust to manage and oversee the construction of the temple- obviously under PM Modi Muslim stand deprived of Babri Masjid.

The Supreme Court of India has lost its credibility by facilitating the agreement between RSS and BJP to facilitate PM Modi for becoming the Prime Minister of India. The conditions of thus agreement between RDD and PM Modi are as under:

Revoking/ Scrapping/ Abrogation of Article 370 and 35 A, repealing the special status of the People of Kashmir.

Construction of Ram Temple at the place of Babri Mosque.

Introducing the system of common Hindu community customs in India.

Mr. Verma- a famous Indian Archeologist has already verified and confirmed through his challenge in the court that Babri Mosque was not constructed on the Mandir. In a padded report by A 320 where it claimed that the Babri Mosque was constructed on the remains of Hindu temple which has been denied by an independent Archeologist.

The history of RSS and PM Modi being extremist is now well documented both in India and International Human Rights bodies including a well-documented investigation against PM Modi where he was declared in top 10 terrorist. PM Modi managed his exit with the Americans by demonstrating his anti-Pakistan Syndrome in line with Afghanistan and US.

Babri Masjid was demolished with the RSS street support and the person who led the demolishing campaign along with two other were converted to Islam. Was Babri Singh was a popular leader of “Shiv Sena” who climbed the dome of the Babri Mosque later converted to Islam and his Muslim Name is Muhammad Amir. Muhammad Umar a friend of Muhammad Amir was YogendraPal. Shiv Parasad was a youth leader of Bajrang Dal. He actively participated in the demolition of Babri Mosque but after the incident he went in mental stress and suffered badly from hallucination. For the change of his mindset he flew away to Sharja where he embraced Islam and changed his Name to Muhammad Mustafa.

I have a question that why these attackers were not called by the Supreme Court of India to take their point of view. What we could expect when Samjhauta Train Trial judge was a close friend of Indian PM Modi who facilitated the way out for Lt. Col Shrikant Purohit and similarly the RSS blocked evidence related to Babari mosque to the court. Similarly Babri Masjid case was also tried by the friends of PM Modi under the terror of RSS. The Babri Mosque demolition was engineered conspired under the RSS Command.

The people of Pakistan has realized that PM Modi got this verdict announced on the same day when the Sikh Community was celebrating the holy day of their religious and spiritual leader Baba Guru Nanak. Although PM Modi has thanked the Government of Pakistan for opening the “Kartarpur Rahdari” halfheartedly and at the same time got the Babari false judgment on the Kartarpura day. By Announcing he has shown his anti-Muslim and anti-Sikh sentiment on this great eve. The courtesy by the Government of Pakistan has been frustrated against the wishes of own Sikh Indian community which is the legitimate citizens of India. This judgment of Indian Court is under the influence of RSS needs to be condemned.

I purpose that Organization of Islamic Countries should raise this with International Court of Justice as this is against the UN Charter of Interfaith Harmony. India is a signatory of that charter. RSS and Modi will not only harm the Muslims of India and Pakistan but they will also harm the Muslim community of South Asia. He will take many brutal actions to force the conversion of Indian Muslims into Hindus or to force them to leave India under his declared “Hindutva Ideology.

I appeal to the Secretary General of the United Nations to immediately summon a special session and take the notice of this gross violation of inter faith harmony by destroying a Religious worship place and have the judgment declared null and void through ICJ. Let us see what initiative will be taken by the OIC to save the honor of Muslims in India or will it keep having a cozy sleep on Caged Kashmirs.

Whereas the courtesy extended by Pakistan to Indian Sikh community has not been liked by PM Modi, the C - in -C of RSS. In addition Modi had hinting about the judgment of Indian court in advance. RSS wanted a temple in the place of Babari Masjid and PM Modi managed it for his RSS Babies. Can any court in India say “NO” to “RSS” hence RSS can manage anything including such judgments but do not worry Mr PM Modi your down fall will also be in the hands of a faction within RSS.

Fragmented IOK bleeding by Senator A. Rehman Malik

27th October was observed as a “Black Day” in the history of Pakistan and Indian-held Kashmir as a protest against the illegitimate occupation of the Kashmir as this day in 1947, India had forcibly taken over Kashmir turning the valley into the largest jail of the world. Since October 27th, 1947 Indian troops are committing unprecedented brutalities in terms of mass murdering, mass blinding through pelleting, rapes, tortures, enforced disappearances, political repression and suppression of freedom of speech. The valley has witnessed all kind of brutalities since day one yet the international community and so-called champions of human rights are sleeping and even the United Nations couldn’t implement its Security Council Resolutions on Kashmir and silently witnessing the worst kind of human rights violations in Kashmir turning a blind eye. We all know that the day was observed & passed with speeches and some mini long marches by some activists.

This day, we protest about the brutalities and other sufferings of Kashmiri brothers and sisters and also remember and pay tribute to the heroes and martyrs of Kashmir who sacrificed their lives while struggling against Indian brutalities. We kept on talking and our verbal support continued which could not stop to fracture IOK as PM Modi managed to divide it into three administrative units while UN also could not give any relief to the Kashmiris.

Our Prime Minister stood on the dice and addressed the 74th session of the UN General Assembly but no one ever thought to move a resolution to seek a fixed date for plebiscite in Kashmir which is the legal right of Kashmiris under Resolutions already passed by UNSC.

Hence we now need to opt to adopt aggressive diplomatic policy and use international community & media but it seems Ministry of Foreign Affair (MOFA) is perhaps not considering it seriously.

It is even more painful that India is managing the suppression of Kashmiri voice by diverting the attention towards the Line of Control (LoC) from the actual problem of Kashmir. It was great that foreign diplomats were taken to witness the targets and the damage caused by Indian shelling at LoC. Earlier Indian troops were killing innocent people in Indian Occupied Kashmir (IoK) and now they have started shelling on the civilian population of AJK killing innocent people and damaging their houses.

According to official sources alone in 2018, there were 3038 Indian ceasefire violations and 58 civilians were martyred while 319 were injured. In 2019, so far there have been 2,608 ceasefire violations due to which 44 civilians have been martyred and 230 injured. There has been a clear increase in the ceasefire violations at the LoC but yet Ministry of Foreign Affairs has not lodged any complaint in the UN with specific charges and damages claim against India.

I wrote a self-explanatory letter to Foreign Minister Shah Mehmood Qureshi on 16th August, 2019 which is reproduced here,

Dear Shah Mehmood Qureshi Sahib,
I would like to draw your kind attention towards the unprecedented brutalities being committed by Indian Government under the direct command of Prime Minister Narendra Modi in Indian Occupied Kashmir since long and unhindered and unfortunately are being consistently ignored by the United Nations and other international relevant forums. The recent unilateral and illegal decision by the Indian Government to revoke the Articles 370 & 35-A basically to scrap the special status of Kashmir, is also a sheer violation of the United Nations Resolutions.
2. I call upon you to consider to immediately move the United Nations against Prime Minister Narendra Modi and the Indian Government for committing unprecedented Indian illegal act and ongoing brutalities against innocent Kashmirs in terms of mass murders, mass blinding through pelleting, enforced disappearances, tortures, rapes, political repression and suppression of freedom of speech including total curfew in the area, which is gross violation of international human rights. The International Human Rights Commission has already reported these violations vide its report.
3. Indian has been persistently refusing the human rights body to visit inside the Indian Occupied Kashmir and is continuously committing human rights violations without any fear and has chosen to ignore the investigative observations of the International community. India being the Member of United Nations is liable to be penalized for above continued violations of human rights and also for not implementing the UNSC Resolutions of self-determination i.e. Resolutions, No.47 (1948), 98(1952) and 122(1957).
4. I have been fore-warning the ill intentions of India regarding the demographic changes in Kashmir and efforts of Prime Minister Narendra Modi to convert the Muslim Kashmirs population into minority and the real planning of India stood exposed with the scrapping of Article 35-A allowing the purchase and allotment of property to the non-Kashmirs.
5. I would like to mention here that I have already issued a Charge Sheet against Indian Prime Minister Narendra Modi, on 5th February, 2018, highlighting the ill-motives of Modi’s government, which he has brought in by scrapping the special status of Kashmir. Kindly use my timely apprehensions which went unnoticed by the UNO.6. I, therefore, hereby propose you as Minister of Foreign Affairs/Government of Pakistan to move the United Nations on the following:-
i. The United Nations may be requested to implement its own Resolutions of self-determination by announcing a specific date for holding the plebiscite in Kashmir.ii. The United Nations may be requested to immediately deploy its Peacekeeping Mission in Indian Occupied Kashmir for sustainable peace and to ensure peaceful and free and fair plebiscite within the period announced by UNO.iii. The United Nations may be requested to direct UN Human Rights Council to constitute a High Powered Commission to observe and investigate the sheer violations of human rights by Indian Forces in the Indian Occupied Kashmir and submit a consolidated report to expose the Indian aggression.iv. The United Nations may be requested to immediately restore the original special status of Kashmir by restoring Articles 370 & 35-A.v. The United Nations may be requested to place India under international Sanctions as penalty for persistently violating the United Nations Resolutions on Kashmir and violating will of International community.vi. The United Nations may be requested to refer the matter under Rome Convention to file a case against Indian Prime Minister Narendra Modi, Indian Army Chief and against the Indian National Security Advisor as war criminals, based on the authentic report already submitted to the UNO by President International Human Rights Commission. Many Kashmiri organizations, families of the victims, living blind innocent Kashmirs suffered through the pelleting and raped women are ready to testify these Indian ongoing brutalities against innocent Kashmirs in terms of mass murders, mass blinding through pelleting, enforced disappearances, tortures, rapes, political repression and suppression of freedom of speech including total lock-down.vii. I would like to point out that one close-door meeting of UNO will not work as it will be used to de-escalate the built-up pressure on India and I propose that Pakistan should once again request the Secretary General United Nations for calling another open session of United Nations Security Council inviting Pakistan to present a proper and consolidated evidences against India to shake up the International community who are not paying any attention to the oppressed voice of people of Kashmir.viii. I, as a Parliamentarian feel that we need to do much homework to face India on borders, diplomatic and legal front. I would like to put on record that India will leave no stone unturned to propagate high level blame game, pressure on LOC and inflict our economy through hybrid war planned out to assure anti-Pakistan syndrome under the government of Indian Prime Minister Narendra Modi.ix. I hope that the Ministry of Foreign Affairs will immediately appoint a legal team consists of competent lawyers to move the United Nations with above proposals, convincing our friendly countries for their support that the implementation of UNO Resolutions could be ensured and trial against Prime Minister Modi could be referred to International Criminal Court (ICC).Regards.

I wish the MOFA had acted on said proposals in the letter but instead of acting on these proposals the govt has adopted a soft stand against India. It is so shocking to see despite China & Pak being on one page, Kashmir has been cut into three pieces and the world & UNO is watching heartlessly bleeding Kashmir.

I heard PM saying that he will become the advocate of Kashmiris but question arises as to which forum he will choose to advocate the right of the Kashmiris when even our own Muslims have become deaf.

Mr. PM As you could use your all State resources to expose India and force UN & Modi for self-determination, Kashmiris are calling us with their tied hands and shackles in their feet caged by PM Modi. Kindly act as PM with full strength to give heavy moral & political punches to India and wake up UNSC to get relief to Kashmiris. PM Modi is making successful tours in the Middle East rubbing his shoulders with those who in fact should have created iron wall against the Indian brutalities in caged Kashmir.

Indo-Pak conflict vs 5th gen warfare by Senator A. Rehman Malik

PM Modi has been the byproduct of hardcore militancy monitored by RSS, his mindset is tuned to war and terror so we should not expect any move of peace from his side.

Indian former PMs used to believe in the Cold War doctrine while PM Modi being exceptional has enhanced 5th warfare generation. In order to promote his 5th generation warfare agenda, he has taken following initial steps;

1. Conversion of Kashmir issue into an even more complex issue by scraping its legal status through abrogation of article 370 & 35A.

2. Violation of Indus Water Treaty in a bid to grab control over Pakistan’s share of water. PM Modi does not only want Pakistan’s side of river to go dry but also to hit its agricultural sector directly.

3. He took steps to pull our economy down by lodging a false complaint against Pakistan in FATF with the help USA.

4. He has constantly been trying to destabilize Pakistan through its intelligence agencies which play dirty tricks against our country by planting seeds of terrorism through anti-Pakistan elements on our soil.

5. Doing propaganda against Pakistan, painting it as a terrorist state.

6. He keeps trying to block the development in Pakistan through CPEC.

India has also been mercilessly committing brutalities in Kashmir as it is the 78th day of curfew in IHK which was imposed by Indian Interior Minister Amit Singh who is likely to replace Modi as next rising leader of BJP that might become the next Prime Minister as well.

The Indian government under PM Modi was too scared of Kashmiris before snatching their right of special status that they had already started taking the following measures in Kashmir:

1. Blocked internet and telephone services

2. Ousted beforehand the local and International media persons

3. Sealed the valley

4. Increased the number of Indian troops

5. Increased its own lobbing to counter the reaction in defense of international opinion for Kashmir

In fact India divided the Kashmir operation into three phases:

In Phase 1, Pulwama plot was created as PM Modi engineered the Pulwama attack himself to win election and also projected bad name to the Kashmiris.

Phase 2: PM Modi rigged elections as per the agreement between himself and RSS – as a part of election manifesto, Modi announced his plan on Kashmir and did exactly the same during phase 2 after winning the elections.

Phase 3. After scraping the status he propagated the change as part of Indian constitution hence propagated this change as its internal affairs of India that he is still advocating in the whole world.

Phase 4 – He worked out the strategy to contain Pakistan in the given situation as it is the main stake holder of Kashmir with India. He knew it well that Pakistan would never stop its moral support of Kashmiris and Pakistan’s opposition over this matter was rightly expected. Hence during the 4th phase of his plan he made sure India continues to increase pressure on Loc in order to engage Pakistan on the borders so that it would talk more on LOC rather than Kashmir issue.

India has deliberately disrupted the LOC to engross the attention from Kashmir issue which can be proved by looking into the statistics of human rights violations in Kashmir from year 2017-2019.

Now if we analyze, it would appear as to be true that India is killing civilians on the LoC and making false claims under the policy of PM Modi who is behaving more a like film actor than a statesman. In fact Indian Prime Minister Narendra Modi has been consistently acting like a Bollywood actor as previously as well he did the drama of fake surgical strikes at Loc. PM Modi used this tactic of fake surgical strike during his election campaign to attract the attention of voters by engineering Pulwama attack and eventually blaming it on Pakistan. Even the media in his country is no less as the aired the news of these imaginary surgical strikes in complete Bollywood style. These immature attitudes of Modi as statesman and the irresponsible media working at his payroll are bringing bad name to India.

Prime Minister Modi should behave like a real statesman and come out of this fake surgical strike illusion. He is only trying to impress his opponents by doing so as surgical strike on Pakistan could only happen in his wild imagination. PM Modi is converting a secular India into an extremist state rapidly by extending full support to Indian terrorist organization RSS which is expanding from Nagaland to East Punjab in India. I appeal to the Indian opposition parties to stand against Narendra Modi to block his agenda of converting India into an extremist state. I would like to continue to expose the RSS and Modi’s mindset against Pakistan, India has had a history of false and persistent motivated flag operations.

In few of the above facts, it looks as if Pakistan is on purpose being engaged on LOC to divert its attention from Kashmir issue.

The public is noticing the government has soft approach towards Kashmir as India is continuously violating the cease fire on LOC yet it is doing nothing about it.

The government should have brought the section of ceasefire violation of the Truce agreement 1949 in to light which was designed by the United Nations Commission on India and Pakistan constituted by UNGA as according to this agreement both countries have signed the following declarations:-

Para B: The delegation of India and Pakistan, duly authorized have reached the following agreement:

(1) “Under the provisions of Part I of the Resolution of 13 August 1948, and as a complement of the suspension of hostilities in the State of Jammu and Kashmir on 1 January 1949, a cease-fire line is established”.

Para F: ….There shall be no increase of forces or strengthening of defenses in areas where no major adjustments are involved by the determination of the cease-fire line.

India has violated these sections hence Pakistan needs to file a serious complaint against and claim damages which would be a perfect legal proceeding.

India has to be brought to international level taking into consideration the following actions:

A: Drag PM Modi to the ICC court under Rome Convention for being involved in ethnic cleansing of Muslims in India.

B- Lobby in the UNGA for announcement of date for self-determination.

C. Make out a case for investigation by UNGA to ascertain the delay in implementation of self-determination.

D: File lawsuit against India for carrying out terrorist activities on Pakistani soil.
