I as an Interior Minister of Pakistan for 5 years hardly remember a day when major or minor act of terrorism was not reported and I am happy to report to this forum that we gradually used all available tools to smash their head and our blood battle with terrorist in Malakand, Swat was the deciding factor against the terrorist. Largely we have controlled the situation now but still Daesh is rising its head from the neighborhood and limited number of terrorism acts are still continuing.

Before moving onto the Countering Measures I would like to evaluate that how the modern technology is being used by the terrorist Organizations for achieving their targets. It is already discussed that the Modern terrorism is instantaneous and unpredictable. There is a need for assessment as to how the modern technology is being used by the terror organization in their acts of terrorism:-

Internet/ Electronic communication is equally available to the terrorist and the states.

Terrorist operate under cover using the weakness in Social Media.

The secured Communication through various apps available to both states and terrorist.

Cyber Terrorism by concealing the identity, fake news, hacking the accounts, online transfers of funds through hacking, use of ATM for terrorist fund raising etc.

Motivational tools of the terrorist for recruitment and deployment. The terrorist are motivated with religious fantasies, luring in of economic benefits and brighter future as a terrorist.

For deployment the terrorist are trained as per their expertise keeping in view their origin and their qualities of infiltration and the mindset against a certain act to justify their actions.

Suicide bombing through direct detonation, through mobile device, through internet, through Wi-Fi and through mobile SIMs. Pakistan suffered very heavily because of suicide bombing both with self-detonation and remote control detonations against Pakistan Army and Civilians. As interior Minister after a thorough study I decided to block the mobile phones in certain areas and the areas with threat alerts, specific religious occasions, big prayers and processions and it reduced the bombing by more than 80% immediately.

Mines have been experienced by Pakistan though it was a military weapon but normally the terrorist protects their vicinity with mines and attack the Law Enforcement Agencies with Mines detonation.

Use of false documents for travelling, hiring the id and infiltrate into organizations etc. through the falsification of documents.

Pakistan experienced to see the camps of terrorist used in Afghanistan basically the same training camps with US Intelligence developed the Jihadis’ against Soviet Union and these are being used today by Al Qaeda, Taliban and Daesh.

Today, the availability of weapons of mass destruction, including chemical and biological weapons is what makes it a thing of present-day called “Modern Terrorism”. The modern day weapons and technology have made terrorism a particular source of dread. The way terrorists have modernize themselves with the use of advanced technologies and weaponries, it is about time that the world community should also find new ways, technologies and counter strategies in order to put an end to these never ending tragedies caused by Terrorism.

Having gone through the assessment of the technologies; being used by the terrorist now we are in better understanding of employing the workable Innovative and Technical Countering Measures against Terrorism. An account of the same is discussed hereunder:-

Digital Intelligence Tools. The use of Electronic surveillance through GPRS system and through Drawn Technology. These two tools have been used by Pakistan very effectively and our Law Enforcement Agencies have the capability of zeroing the terrorist localities.

Digital Forensic Tools. The Forensic analysis of the available data based on the captured terrorist, potential terrorist/ groups identified and to develop further leads through cyber forensic by using all available software’s to analyze the telephones internet data leading to the terrorist/ terrorist groups. Tools capable of rapid unlocking, extracting, decoding and analyzing the digital data from multiple sources including the cloud being able to analyze and sort through large volumes of data with speed and it is critical to identifying terrorists and their accomplices as well as preventing future attacks

Techniques To Extract Data. The Law Enforcing Agencies have got techniques to reach to the terrorist with the available basic information like telephone, email, use of applications, Interconnectivity with in the terrorist groups using various code which can be disport We have been able to successfully reach to the terrorist through IMEI Numbers and Cell phones SIMs the terrorist normally used cellphone SIM through the handset with multiple IMEI numbers. Which means that, the same IMEI is sometimes used in thousands of the handsets which make the task of the Law Enforcement Agencies bit difficult in the way of extracting the data however data can be extracted from certain devices using nondestructive techniques, even if they are damaged, and nonfunctional. Of course, it depends on the level of damage, but having this capability is massive, especially in the case of an actual event

Artificial Intelligence. Terrorist always use the camouflage and hide their identity through sketches, stolen id etc. on the social media. They avoid using the known IP addresses and prefer to use those which will be in use at public places The material, arms and ammunitions and detonation material is normally exchanged either by train, by their own transport at a given point or be shared through codes. We identified over thousand codes which the terrorist have been using by using pages of a common book in which remained successful till one end was intercepted. A leading Social Media Platform has announced that it is using Artificial Intelligence to find and remove terrorist content from its platform behind the scenes it uses image-matching technology to identify and prevent photos and videos from known terrorists from popping up on other accounts

Countering Terror Financing.It is the back bone and promotion of terrorism in the world Terrorist raised their funds through following means:-State sponsored terrorist through the respective governmentsRaise funding through drugs traffickingRaise funding through kidnapping for ransomRaise funding through Bank dacoits 

Top class hackers from hefty accounts with well-organized disposal of funds at the other end immediately

Some terrorist are part of the money laundering network Hundi.

The most essential phenomenon to break the back bone of the terrorist networks all over the world is to curb the terrorist financing.

Most modern technologies are being used to provide the terrorists with the finances for the execution of the assigned targets. In order to track the terrorist financing sources it is essential to monitor the flow of economy and the identifying the invisible trails

As a Law Enforcer for 30 years and Federal Interior Minister having fought terrorism for 5 years and still fighting against it, as Chairman of the Senate Standing Committee on Interior I firmly believe that the terrorist cannot have sustainability unless they have backing either by a State, Powerful Criminal Mafia or Powerful Business groups. The terrorism for state, aggressions and economic gains are carried out by highly sophisticated and well educated individuals which are well protected pre and post operations.

The exploitation of the religious elements is the worst sort of terrorism where the motivation tools are used to exploit his love for his region. It is basically the creation of a mindset against a group, a religion or a state where a terrorist has been trained with a very strong mindset that, he won’t mind giving his life using more lethal ways and means of killing the people.

The subject is very interesting; Terrorism has emerged like a stake holder in the respective field. Obviously it is a difficult task to counter a modern terrorist with modern gadgets and means with available state resources as the terrorist does it operation in a hidden way and they prayed like the financer, group head, handler, supervisor and then the executor of the terrorist act. They use many cut outs in communications and I experienced numerous cases but the murder of Shaheed Mohtarma Benazir Bhutto is one of the example where it took use three years to break the terrorist network.

We as international community need to carry out the next level of counter terrorism approaches and strategies collectively to inflict a heavy blow upon this mammoth of terrorism. As a mean to eradicate the terrorism to the core we need to attack both the manifestation as well as the underpinning cause of the extremism. The military solution alone cannot be helpful enough to solve the problem of terrorism as it rather adds fuel to it. Even the sole use of diplomacy or dialogue with the terrorists is not sufficient as it creates weakness. A combination of different factors would help us resolve the issue including the use of force/military, diplomacy, education, technology as well as patience.

It was a great International forum which I have used in favor of Kashmir, although the topic was not directed particularly towards Kashmir but I somehow managed to induct Kashmir In the said conference and brought the sensitivity of this issue into the notice of International Community.

Today, as I spoke and presented the paper below in the UNO- IPU joint conference on the subject of Counter Terrorism in Belarus, I am really happy to state that I also raised the issue of Kashmir in most effective way during the two speeches I delivered in front of International media.

I made an appeal to the International Political Elite and Senior Members of UN to pay attention to the screams of Kashmiris who are under curfew since last one month. The International community is requested to ask Pm Modi to lift the curfew on SOS basis.

Before I could start my speech on what innovative approaches and latest technologies could be used to counter the plight of terrorism, I gave a detailed introduction of what terrorism is and why is it becoming a source of fear and distress.

Terrorism is mainly used to achieve political, religious and ideological ambitions and can be defined as the use of terror as weapon to create violence against persons or property to achieve the nefarious designs and targets. Terrorists mainly try to make the government hostage, the civilian as a target of terror, pitch one sect of religion to the other to gain political, economic and social objectives. The history of terrorism is as old as human presence on earth Terrorism is motivated towards creating a sense of fear among the people from different communities and the countries worldwide. In Modern language we can say the terrorism has transformed into a fear technology which contains multiple factors to scare people and governments to achieve the objectives conspired by terrorist groups, individuals and covertly by some states to achieve certain International geo-set of objectives. Although Terrorism is not something new and also can’t be termed as being a modern concept but its manifestations, tools and approaches are turning as modern and innovative.

Now the world has witnessed that the terrorism has been adopted as a tool to achieve a certain objective through act of terror. The most common causes or roots of terrorism include:-

Civilizations or culture clashes

Globalization

Individual-based reasons for terrorism are:-

Frustration

Deprivation

Negative identity

Conceited rage

Moral disengagement

I am constrained to say that terrorism has also developed a tool of war which can be termed as an act through guerrilla or act of violence on specific targets by creating terror of terrorism. It is unfortunate that the world is developing a dangerous trend of creating and training groups to act as terrorist to achieve the specific targets against the enemy country

In short, terrorism is not legally defined in all jurisdictions; the statutes that do exist, however, generally share some common elements. Terrorism involves the use or threat of violence and seeks to create fear, not just within the direct victims but among a wide audience.

If we evaluate the existence of the concept of terrorism we will find its roots in the ancient history. However in civilized communities it is referred back to the French Revolution of the late 18th century when terror was used as an instrument of State Policy and in 19th century Narodnaya Volya a Russian terrorist organization used terrorism as a tool to achieve the political goals. In late 90’s, Kurds living in Syria, Turkey and Iran used terrorism to form a separate Kurdish state for themselves whereas in the same time period the Sri Lankan Tamils named as liberation Tigers used terrorist activities along with drugs trafficking with a strong support to the terrorist from the neighborhood.

Presently, The Hindu extremist Sangh Parivar and mainly its Central Organization Rashtriya Sawayem Sevakh Sangh RSS are spreading violence and extremism across the India in order to eliminate the minorities residing in India and this is a new phenomenon in the form of RSS ideology based on religious extremism duly investigated by the U.S. Commission on International Religious Freedom declaring in its 2004 recommendations, proposed that India be included on the State Department’s official shortlist of the worst religious persecutors for its “egregious, systematic, and ongoing” violations of religious fights. The designers of terrorism used religious groups as terrorists which are now an open secret that the world witnessed in Pakistan, Afghan, Philippines, Iraq, Syria, Libya, Egypt, and Nigeria. There is a lot which can be spoken with authority and let me leave it for some other occasion. Al-Qaeda, Hizbollah, Hamas, ISIS and Boko Haram are world known lethal terrorists organization justifying their acts of terrorism in the name of Religion whereas they talk about religion but nothing to do spiritually with it. The new phenomenon of Daesh ISIS is fast emerging a lethal terrorist Organization and the world reach to block its inhuman activities. For reference I would denote my book “Daesh –ISIS Rising Monster worldwide” which I produced basing on the ground realities, personal experiences and my analytical skills with respect to my experience in the field. The war between the former Soviet Union and US in Afghanistan gave emergence to Jihadis, Talibans and subsequently Al Qaeda Whereas the entire lot of terrorist hailed from Middle East and not even a single terrorist from Pakistan or Afghanistan but both the countries are still suffering because of 9/11.

Today’s terrorism is much more different and fatal than that of the past because of the use of modern technology by the terrorists posing a threat that is qualitatively different from a damage based on firearms or chemical explosives used in the past.

While discussing the terrorism we need to comprehend its types and forms. With the division of the targets and the goals it can be divided into following classes:-

Religious Extremist turned into Terrorists with motives which are present in almost every religion

State-Sponsored Terrorism to achieve the geo political targets or targets against the given enemy. Now the espionage against the enemy is overtly done through acts of terrorism. Whereas espionage itself is a form of terrorism for the victim country.

Anti-State groups using Terror as a weapon to blackmail the state.

Socially distressed groups use terror for psychological reasons like what is happening in US by random individuals.

Use of terrorism to promote certain criminal activity including drugs production, drugs trafficking, Money laundering and any other benefit to be achieved via terror.

Historically speaking the biggest sufferer in the hands of terrorist from all over the world is Pakistan where we have lost:-

According to Pakistan Economic Survey (PES) 2017-18 Pakistan suffered a loss of $126 billion in the 17 years

Pakistan faced losses of $2.67 billion in the year 2001-02 when United States invaded Afghanistan with the year wise losses gradually increasing till 2009-10.

Terrorism dented Pakistan’s economy by $9.18 billion in 2008-09, $13.56 billion in 2009-10, $23.77 billion in 2010-11, $11.98 in 2011-12, $9.97 billion in 2012-13, $7.70 billion in 2013-14, $9.24 billion in 2014-15, $6.49 billion in 2015-16, $5.47 billion in 2016-17 and $2.07 billion in 2017-18

Pakistan could not collect $3459.67 million tax due to terrorism in last two years, in addition, $383.93 million has been spent on infrastructure and $129.89 million paid to affectees of terrorism.

War on terror cost the proceeds of privatization by $251.19 million and industrial output by $1043.90 million.

Finance Ministry reveal that due to war on terror, Pakistan had to face $10 billion losses per year in trade.

Pakistan’s success in countering-terrorism was acknowledged in the Global Terrorism Index Report 2017 published by the Sydney-based Institute for Economics and Peace

Pakistan has shown improvement in its global terrorism index ranking with a decline in the terrorism incidences and the deaths related to terrorist activities

During 2008-10 the GDP Fallen from 7.8 to 3.5

In addition to the above quoted report, the foreign investment up to $1234.40 million could not be attracted to Pakistan due to the war on terrorism. The investment and development are directly linked with the peace and security of the Country. I feel pain to inform the International Forum that the deteriorating security situation in the country while helping other ally’s created very unfortunate, distressing and scary security environment in the country which ultimately stopped the investment from abroad adding a bigger stress to our economy. I feel very disheartened to report to you that the country who suffered because of helping in War against Terrorism, Terrorist Financing, Money Laundering, Tracking and attacking the terrorist Ids now stands in grey list of FATF for some petty complaints from the neighborhood country. My nation has a question to the entire International community and I ask this question on behalf that is it the reward for taking side of USA against the crimes against the humanity, and after heavy suffering ultimately we have been now hunted from a hunter? Which is total injustice by some powerful in the international community. The entire country suffered in the hands of Taliban and Al Qaeda both on borders and inside the country.

India under unholy rule of Modi via RSS By Senator A. Rehman malik

The fast changing circumstances in this region are detrimental to regional peace. Afghanistan is going through highly uncertain dangerous transition as the final outcome of USA/Afghan dialogue is not yet certain. USA is focusing on this issue while I do not expect any positive outcome from Donald Trump’s mediation in favour of Pakistan as USA will pressurize both Pakistan & India to first support USA in resolving Afghan Taliban issue as per its strategy.

I foresee the increased intolerance in India under RSS as Modi is just a puppet in the hands of RSS. India will experience the worst ethnic clashes between Muslims and Hindus and there will be a mass migration from India to Pakistan and Bangladesh. Modi is trying to fulfill the section of the agreement signed with details as below:

Illegal Scrapping of Article 370 and 35 A: The special task was assigned to the PM Modi and Shah about the status of the Kashmir. The Modi has to abrogate the special status of Jammu and Kashmir since RSS termed the Kashmir issue as self-created problem that former secular socialist governments in India had created for the country. With RSS, the solution of the Kashmir issue is what is practically done by the Modi Led BJP Sarkar. One can conveniently determine that the applied solution of Kashmir issue is one of the prerequisites of the concept of Hindutva. Thus, Modi has brought in the power for another term to accomplish the task of abrogating the special status of Jammu and Kashmir, which he delivered.

Implementation of a common civil code against Human rights & Interfaith violations: They are determined to implement common civil code so that different religions cannot follow their own laws for issues like marriage and owning property. In the vision of the Hindu extremism, it is tasked that no other religious practice should be followed, thus encouraging in the announcement of the common civil code so the different religions cannot practice their own laws for the key religious issues. Mainly the common civil code targets the religious minorities in India. As the RSS claims that Hinduism is not a religion, but a way of life so with the common code, the cultural and religious values of the minorities will be snubbed and they will be forced to adopt the Hindu culture and values. The ultimate objective of this chauvinist mindset is to ensure that in Indian none other than Hindu religion should prevail.

Building a Ram temple in Ayodhya : The continuation of “Ram Janam Bhoomi Movement” led to the unrest in Gujrat. The then Chief Minister of Gujrat Narendra Modi government played the role of the silent audience while its parent Sangh led by L.K Advani with the majority from Vishwa Hindu Prishad played worst with the Muslim community. The bewildering behavior of the RSS sponsored killings during the regime of Narendra Modi was his conformity to the Hindutva ideology. During the movement,lots of the Muslims from Gujrat lost their lives in the hands of extremist Sangh Parivar parties but Narendra Modi did not react against them. In his election manifesto Narendra Modi has given his word to his creating RSS for building the Ram Mandir and after the execution of his first promise regarding abrogation of Kashmir now he will be heading for the construction of “Ram Janam Bhoomi Mandir”. Modi with his destructive mindset will change the following:

a. He will first change the Demography in Kashmir to convert the Muslim majority into the minority. The special status of the Kashmir is demolished to pursue the demographic changes in Kashmir in addition, to convert the Muslim majority in to Muslim minority. The basic aim of Modi government is to implement the Hindutva ideology as it is tasked to the Prime Minister Narendra Modi. In the past, Hari Singh, who was the ruler of the disputed territory, pledged that Kashmir should be an independent state. This territory of Jammu and Kashmir was carried by the fore fathers of the Hari singh as an autonomous and independent state. The Modi government breached this status by attacking this territory and demolished the special status of the Jammu and Kashmir. b. They are trying to destabilize Pakistan through Baluchistan in order to hinder the economic growth perceived with the success of CPEC. India has created the hybrid war to destabilize Pakistan and gain a successive economic power in the South Asia region. It has attempted many intelligence operations in Baluchistan. By attacking the region of Baluchistan, it was aimed to destabilize Pakistan by dividing Pakistan into parts and engaged them in nationalism issues. The Indian also attempted to destroy the CPEC project in order to cut the development in Pakistan but instead of being successful, the Indians faced defeat every time. c. He wants to execute the larger plan now which is to impose the cause of Akhand Bharat as his ideological agenda. It entails the creation of Indian Union on the forum of European Union. For this purpose, India claimed to have the government of its choice in Bangladesh. It refers to revive the subcontinent into its pre independence state. The hostility and aggression against Pakistan and the Muslims in India and Kashmir is to achieve the dream of Hindu Rashtra. By scrapping Article 370, the Indian Governments has started its move towards the transformation of India into the only Hindu’s state. d. Prime Minister Modi is planning to isolate the Pakistan from the international community by any means, weather it is trade or diplomatic relation of Pakistan. Recent action of the FATF is the key element which shows the plan of the Indian government to defame Pakistan in the financial affairs. The Indian media is using doctored videos to defame Pakistan. The recent air strike of Pakistan on India made India bow its head yet on the other hand the Indian media was engaged in making false propagandas against Pakistan by using doctored videos of air strike but this fact was tracked by the world how the Pakistani force replied to the violation of Indian air craft. India has also been trying to disconnect Pakistan from the international community. Thus, this is all the part the larger plan of Modi government to out ray Pakistan from international affairs and to pave the way for Hindu extremists.

It is a matter of fact that Modi has the ball rolling for the disintegration of India.

Caged IoK and helpless UNO by Senator A. Rehman malik

It has been seventy years three months and twenty days since we are making tall claims about Kashmir but in actual so far we are failed as neither could we get the UNSC Resolutions on Kashmir implemented nor we could create a strong lobby which could have forced the United Nations to at least get its own resolution implemented. Though we are grateful to the China for requesting the UNSC’s closed-door consultations to discuss Kashmir following the India’s unilateral and illegal move to revoke the special status to Jammu and Kashmir but nothing came out of the meeting behind closed doors, as India has not been asked to restore the special status of Indian Held Kashmir. The world knows that Kashmir is disputed area since day first and it is one of the international known disputed subjects and already number of resolutions have been passed on it not only in the United Nations but other international relevant forums. It is absolutely wrong to presume that the issue of Kashmir was internationalized and declared as ‘disputed’ after the UNSC’s closed-door meeting, which I differ as it is very naïve and undermining to think this way. The world was looking forward for some relief in terms of restoration of special status, lifting of complete lockdown, deployment of UN peacekeeping missions and we were also expecting that UNSC will be announcing a date for plebiscite in Indian Occupied Kashmir (IoK). Our Foreign Office should continue to demand the restoration of special status of Kashmir and restoration of Articles 370 & 35-A.

I was compelled to write a letter to Minister for Foreign Affairs, Shah Mehmood Qureshi to move the United Nations with my six point suggestions. The letter is reproduced here for information.

Dear Shah Mehmood Qureshi Sahib,

I would like to draw your kind attention towards the unprecedented brutalities being committed by Indian Government under the direct command of Prime Minister Narendra Modi in Indian Occupied Kashmir since long and unhindered and unfortunately are being consistently ignored by the United Nations and other international relevant forums. The recent unilateral and illegal decision by the Indian Government to revoke the Articles 370 & 35-A basically to scrap the special status of Kashmir, is also a sheer violation of the United Nations Resolutions.

I call upon you to consider to immediately move the United Nations against Prime Minister Narendra Modi and the Indian Government for committing unprecedented Indian illegal act and ongoing brutalities against innocent Kashmiris in terms of mass murders, mass blinding through pelleting, enforced disappearances, tortures, rapes, political repression and suppression of freedom of speech including total curfew in the area, which is gross violation of international human rights. The International Human Rights Commission has already reported these violations vide its report.

Indian has been persistently refusing the human rights body to visit inside the Indian Occupied Kashmir and is continuously committing human rights violations without any fear and has chosen to ignore the investigative observations of the International community. India being the Member of United Nations is liable to be penalized for above continued violations of human rights and also for not implementing the UNSC Resolutions of self-determination i.e. Resolutions, No.47 (1948), 98(1952) and 122(1957).

I have been fore-warning the ill intentions of India regarding the demographic changes in Kashmir and efforts of Prime Minister Narendra Modi to convert the Muslim Kashmiri population into minority and the real planning of India stood exposed with the scrapping of Article 35-A allowing the purchase and allotment of property to the non-Kashmiris.

I would like to mention here that I have already issued a Charge Sheet (copy enclosed) against Indian Prime Minister Narendra Modi, on 5th February, 2018, highlighting the ill-motives of Modi’s government, which he has brought in by scrapping the special status of Kashmir. Kindly use my timely apprehensions which went unnoticed by the UNO.

I, therefore, hereby propose you as Minister of Foreign Affairs/Government of Pakistan to move the United Nations on the following:-

1.   The United Nations may be requested to implement its own Resolutions of self-determination by announcing a specific date for holding the plebiscite in Kashmir.2.   The United Nations may be requested to immediately deploy its Peacekeeping Mission in Indian Occupied Kashmir for sustainable peace and to ensure peaceful and free and fair plebiscite within the period announced by UNO.3.   The United Nations may be requested to direct UN Human Rights Council to constitute a High Powered Commission to observe and investigate the sheer violations of human rights by Indian Forces in the Indian Occupied Kashmir and submit a consolidated report to expose the Indian aggression.4.   The United Nations may be requested to immediately restore the original special status of Kashmir by restoring Articles 370 & 35-A.5.   The United Nations may be requested to place India under international Sanctions as penalty for persistently violating the United Nations Resolutions on Kashmir and violating will of International community.6.   The United Nations may be requested to refer the matter under Rome Convention to file a case against Indian Prime Minister Narendra Modi, Indian Army Chief and against the Indian National Security Advisor as war criminals, based on the authentic report already submitted to the UNO by President International Human Rights Commission (copy enclosed). Many Kashmiri organizations, families of the victims, living blind innocent Kashmiris suffered through the pelleting and raped women are ready to testify these Indian ongoing brutalities against innocent Kashmiris in terms of mass murders, mass blinding through pelleting, enforced disappearances, tortures, rapes, political repression and suppression of freedom of speech including total lock down.

I would like to point out that one close-door meeting of UNSC will not work as it will be used to de-escalate the built-up pressure on India and I propose that Pakistan should once again request the Secretary General United Nations for calling another open session of United Nations Security Council inviting Pakistan to present a proper and consolidated evidences against India to shake up the International community who are not paying any attention to the oppressed voice of people of Kashmir.

I, as a Parliamentarian feel that we need to do much homework to face India on borders, diplomatic and legal front. I would like to put on record that India will leave no stone unturned to propagate high level blame game, pressure on LOC and inflict our economy through hybrid war planned out to assure anti-Pakistan syndrome under the government of Indian Prime Minister Narendra Modi.

I hope that the Ministry of Foreign Affairs will immediately appoint a legal team consists of competent lawyers to move the United Nations with above proposals, convincing our friendly countries for their support that the implementation of UNO Resolutions could be ensured and trial against Prime Minister Modi could be referred to International Criminal Court (ICC).

Options of Pakistan vs Indian illegal act by PM Modi by Senator A. Rehman Malik

It is now beyond doubt that PM Modi is associated with enough crime data on record for which he can be tried as war criminal along with his army chief and security adviser.

I have been advocating in my articles and speeches about the anti-mind set of PM Modi against Kashmiris and Pakistan which he demonstrated by performing the act of Pulwama and then as usual he blamed Pakistan as he was replicating the incident of Samjhota Express.

Modi was already doing the genocide in Kashmir and his entire apparatus on the ground was to reduce the Muslim Kashmiris to minority like Gaza by Israel. We have a small window of time to act, we need to launch fast measures to get this illegal action of the PM Modi reversed.

I therefore call upon the government for an aggressive launch of the following course of actions to reverse the abrogation of Article 370 and Article 35A before the international competent authorities:-

1. Violation of the UN charter of its own resolution needs to be agitated in the UN. I understand that the government should have gone by now in the Security Council but it looks that the government is slow in its actions and let us hope that the government will win sizeable diplomatic lobby of friendly countries to create strong voices to back the point view of Pakistan & Kashmiris in the upcoming UNO session.

2. The government should immediately move the matter under the Vienna convention/Geneva Convention - Gross violation of Human Rights as per its own findings and insist for legal action beyond media condemnation.

3. Rome convention - which is doable as PM Modi can be tried under war crimes as per charge sheet where I have sufficient incriminate material to prove PM guilty of his crimes as it legally fit charge to drag PM Modi under the Rome convention as explained above as there is ample of irrefutable evidence against the butcher of Gujrat PM Modi.

The profile of Modi is itself a testimony against him and he is the only world leader who rose from the title of being a wanted criminal to the darling PM on the West and he continue to enjoy their support.

I had my first counter when I went to India on my official visit and I faced RSS & RAW influenced journalist who demanded that I should have travelled with an apology for the killing of a captain of Indian Army. I had given a befitting response which was not liked by then CM Narendra Modi, who addressed - me as Viceroy of India.

This CM, keen on extremism drew my attention and I started indexing his activities. He came under my radar after which my interest discovered the real Modi. Over the passage of time, I have been giving a number of predictions regarding ill motives of PM Narendra Modi, his party and RSS against Muslims of India and Kashmir. It was the same time when the people of India declared him as the Butcher of Gujrat. He started coming into the limelight when he was nominated as a candidate of PM’s position by BJP. His political rise stands dedicated to RSS as a trained extremist of RSS.

He learnt the torture and blackmailing techniques with them. I have written details of his rise with militant backgrounds in my book Modi’s War doctrine. His extremist mindset has led him to commit inhuman acts and made him to emerge as chief of extremism. I have submitted a number of charge sheets legally fit for his trial as a war criminal. I had earlier served a charge sheet to PM Modi via Indian High Commission for his brutalities which Indian forces are committing. I sent its copy to UNO with the request to take the notice of human rights violations in Kashmir and asked them to refer the case to International Criminal Court (ICC) but so far no action has been taken yet.

I had mentioned about all the atrocities committed by Modi and Indian army against innocent Kashmiris. In my charge sheet, I had directly called Mr. Narendra Modi out for his every single misdeed as follows to be treated as a final charge sheet with additional material.

• All the mass murders, mass blinding, enforced disappearances, torture, rapes, political repression and suppression of freedom of speech of Kashmiris committed by PM Modi.

• Violation of all the global treaties by not allowing the human rights bodies to access Kashmir to cover the gross violation of human rights.

• Modi is an internationally declared terrorist as he was publicly appeared in ‘Top Ten Criminals’ and for that very reason he remained banned in the USA as per the American law for a decade for his role in killing hundreds of Muslims in Gujrat under the International Religious Freedom Act (IRFA) provision of US Immigration and Nationality Act (INA).

• He is an active member of the RSS (a Terrorist organisation), which has been involved in the massacre of Muslims since its inception. Alone, since January 1989 till 31st January 2018, 94,644 innocent Kashmiris have been killed, 7, 099 were killed in custody, 11,042 women were gang-raped and 7, 485 were injured by pellets. Major above sufferings are during the premiership of Modi.

• Section 370 & Section 35A has been scraped with the ill motives to get RSS trained families in Kashmir by allotting lands and houses to them in Kashmir so that the Muslims living there can be reduced as a minority, which is the utter violation of their rights.

• ‘RSS’ is an anti-Muslim organisation whose only intention is to kill Muslims until India is left with only Hindus residing in it. It’s the same organisation that killed Mahatma Gandhi as it was against the creation of a separate homeland for Muslims.

• PM Narendra Modi and RSS have been involved in all incidents of mass murders of Muslims i.e. massacre of Muslims in Ahmedabad, Gujarat, and the demolition of Babri Masjid, incidents of Malegaon and Samjhota Express and now the same is being replicated in Kashmir.

• PM Modi increased the number of troops in Kashmir to the level of above 700,000 to ruin the peace of innocent Kashmiris who are struggling for their rights as per the resolution of UNSC dated April 21, 1948.

• Even the international community has termed the use of pellet guns against innocent Kashmiris by Indian Army as first mass blinding in human history yet Narendra Modi feels no remorse for ordering it.

• Narendra Modi and RSS are unleashing their actual motive of ethnic cleansing of Muslim majority in Kashmir; by mass murdering Muslims and violating all human rights having no respect for human dignity and honour. According to Akhand Hindustan Morcha’s narrative, there will be no Muslim/Christian/Sikh by 2035 and PM Modi has undertaken this task with full support to this move from extremists.

• The High Commissioner for Human Rights United Nations to constitute a high powered Commission to frame this charge sheet on the violation by PM Modi and prosecute Modi under war crime under the Rome convention

• PM Modi is a terrorist financer as he authorised Kulbhushan Yadav, a spy to carry out terrorist activities in Pakistan.

5. He is protector of money launderers and fugitives and has obstructed Penal actions against international criminals.

In fact, I have been advocating and predicting that Modi and his peers from RSS are planning on ethnic cleansing of Muslims and in order to achieve their goals, they are settling RSS trained families in Kashmir by allotting lands and houses to them in Kashmir so that the Muslims living there can be reduced to the minority, which is the utter violation of their rights.

Modi’s crimes and evidence fulfil the criteria of being called a criminal of war under the Rome convention. The Rome Statute is an agreement which offered ground for the establishment of the International Criminal (ICC). The Rome Statute was approved in Rome, Italy on July 1, 1998 and it came into effect from July 2002. The Court was established to investigate, prosecute and try individuals accused of committing the most serious crimes of genocide, crimes against humanity and war crimes etc.

Article 5 of the Statute deals with the crimes within the jurisdiction of the Court. The criminal activities of PM Modi attract trial under this convention.

The Court has jurisdiction in accordance with this statute with respect to the following crimes:

(a) The crime of genocide.

(b) Crimes against humanity.

(c) War crimes.

(d) The crime of aggression.

The Rome Statute applies equally to everyone regardless of their status, even the heads of the governments are not granted immunity.

There are three ways in which the Court can initiate investigations. First, a state that is party to the Rome Statute can refer a case to the Prosecutor of the Court. This is what the Ugandan government did in January 2004, about the situation in northern Uganda. In March 2004, the government of DRC referred crimes in the DRC to the Court.

Second, the UN Security Council can refer a case to the Prosecutor.

Third, the Prosecutor can initiate investigations into a case on his own initiative, based on credible information that he has received. This information can come from states, NGOs, victims, or any other source.

In 3rd way, where the Prosecutor decides to take action by himself and without a state referral – he first carries out a preliminary examination and then submits a request for authorisation of a formal investigation to the Pre-Trial Chamber of the Court.

In other situations where the Prosecutor receives a referral from a state party, he must check whether the referral can be approved under the requirements of the Rome Statute and whether crimes under ICC jurisdiction appear to be serious in nature and also have been committed. If those requirements are met, the prosecutor must initiate an investigation.

Under the Rome Statute, every accused is guaranteed the highest standards of fair trial until proven guilty. Also a person cannot be tried again for a crime for which he or she has already been convicted. The Court can also exclude the accused from criminal responsibility if that person is suffering from a mental disease or was in a state of unwanted intoxication at the time he committed the very crime.

After a fair trial if the accused is proven to have committed the crime in all consciousness while committing it, he or she can be sentenced to life imprisonment. The Court plans to have pre-trial detention facilities in The Hague. The enforcement of a sentence of imprisonment in the host State is subject to the supervision of the Court. The execution of the sentence is carried out in accordance with international standards governing treatment and rights of prisoners.

The overwhelming evidence of brutalities on the people of Kashmir is itself a testimony of his war crimes. Today, all the facts I mentioned and all the predictions I had made in my book and the articles regarding this PM Modi are proven as truth by the time.

In my book “Modi’s War Doctrine” I had also predicted before Indian elections that Modi will go some extra miles to garner votes and support from his people by inciting hate against Pakistan as well as the Muslims and the world saw how he did achieve his election victory through self-generated act of Pulwama and subsequent drama of imaginary strikes in Pakistan and his further disinformation of killing of more than 300 civilians.

I am of the strong opinion that we need fight on diplomatic and international legal fronts with strong legal teams backed by human rights experts. My charge sheet which is already on public record will be helpful in building our case.

The charges I have put against him have already been published in local and international media including my book “Modi’s War Doctrine” whereas Modi has never denied these charges publicly.

My services with evidence would be Omni present for my country to fight our case on the international front. I have already briefed the government through Senate Standing Committee on Foreign Affairs on 9th Aug.

Our strong and consistent aggressive efforts on the right international forums can reverse this illegal action of India committed against the resolutions of UNO.
