Time for legal action against war criminal Modi by Senator A. Rehman Malik

 

The time for speeches and statements on Indian Illegally Occupied Kashmir is over and now this is the time to move against PM Modi and his accomplices in the International Court of Justice (ICJ). Those who think this matter cannot be taken to ICJ/ ICC are wrong as both India and Pakistan have already accepted the jurisdiction by accepting the trial of the matter of Indian spy Kulbhushan Yadav.

We have several ways to file this petition against PM Modi; using Kashmiri leaders/NGOs and the AJK government as direct victims both in Kashmir and also the victim’s families of those who were so far killed in firing across the Line of Control (LoC). This action is warranted against Modi as a war criminal for his crimes against humanity in IOK. Let a joint Parliament session pass a resolution mandating the government to move action against PM Modi and others as suggested above.

The case of suffering/genocide of the Kashmiris at the hands of the Indian Army under Modi is a much legally stronger case than Kulbushan Yadav.

It was great that we showed solidarity to our Kashmiri brothers and sisters on February 5 and this day is observed every year with emotional speeches by the leaders of both government and opposition but what is the outcome? This year, consensus has emerged in all factions of society including the legal fraternity, politicians and diplomats that the only option to get relief to oppressed people of Kashmir is to drag Indian PM Narendra Modi to the International Court of Justice (ICJ) and the International Criminal Court (ICC) for his unprecedented crimes against humanity in Indian Illegally Occupied Kashmir.

I have prepared a charge sheet against Narendra Modi and his military associates, which will be enough to meet the basic requirement of ICJ and ICC to initiate legal proceedings with evidence I have already provided to the government. According to this charge sheet:

Indian PM Narendra Modi has violated United Security Council (UNSC) resolutions and all international laws by altering the disputed status of Indian Illegally Occupied Kashmir (IIOK).

The Indian Prime Minister Narendra Modi and previous governments before him have committed unprecedented brutalities against innocent Kashmiris in terms of mass murders, mass blinding, enforced disappearances, torture, rapes, political repression, and suppression of freedom of speech.

PM Narendra Modi’s government is violating global treaties by not allowing the human rights bodies to access Kashmir.

Prime Minister Modi is an active member of RSS—a terrorist organisation, which is involved in the massacre of Muslims in India, and his own hands are stained with the blood of thousands of innocent Muslims who are the citizens of Gujrat and now he is replicating the same in Kashmir.

His organisation ‘RSS’ is an anti-Muslim organisation that has claimed to declare India a “Hindu Rashtra”. Indian Prime Minister Narendra Modi and his organisation RSS continue to be anti-Muslims which was demonstrated by killing thousands of Muslims in Ahmedabad, Gujarat, and other parts of India, the demolishing of Babri Masjid, and now the same are being replicated in Kashmir.

Indian Prime Minister Narendra Modi has increased the number of troops in Kashmir to the level of more than 700,000, to kill and inflict violence to peace-loving armless innocent Kashmiris who are struggling for the right of self-determination as per the resolution of UNSC dated April 21, 1948.

Indian Prime Minister Modi has crossed all the limits of brutality and did not feel any guilt in ordering aggressive use of pellet guns against peaceful protestors in occupied Kashmir, which the international community has termed as the first mass blinding in human history.

Prime Minister Narendra Modi is unleashing an ethnic cleansing of the Muslim majority in Kashmir; by mass-murdering and settling the RSS-trained families in Kashmir. They are being allotted lands and houses in Kashmir to reduce Muslims to a minority there, which is an utter violation of the rights of Kashmiri Muslims.

Prime Minister Narendra Modi now stands fully exposed as a murderer of innocent Kashmiris and prime violator of human rights and he has no respect for human dignity and honour.

He planned and executed the Pulwama massacre of Indian Army Jawans and levelled the allegations against Pakistan just to create anti-Pak feelings to win his election. As I mentioned before, Indian Prime Minister Narendra Modi was using five tactics in his election campaign to win the polls. These were to escalate Pak-India tension at the border, to create a war-like situation, to instigate Hindu-Muslim clashes, to create the impression of surgical strikes and to carry out a few Pulwama-like attacks to reverse his sagging popularity among the Indian voters.

India successfully launched a conspiracy with billions of dollars and there is an independent report on the crime committed by India from other soils which is now a matter of public record duly exposed by DisinfoLab EU as the ‘Indian Chronicles’. This is a perfect and foolproof case against India to be agitated in the UNSC for the necessary legal proceedings against Prime Minister Narendra Modi for his baseless allegations against Pakistan after Arnab Goswami’s WhatsApp chat leaks and revelation by DisinfoLab EU. Both leaks have exposed the real face of the BJP and Narendra Modi before the world.

The government should take-up this charge sheet to the International Criminal Court for the trial of PM Narendra Modi, his Army Chief Gen. Bipin Rawat and all Indian authorities responsible for war crimes in Indian Illegally Occupied Kashmir.

Rubber stamps; made in parliament by Senator A. Rehman Malik

 

September 15, 2020 was another unforgettable day in the parliamentary history of Pakistan when a joint session was summoned to pass FATF’s dictated legislation. The joint session was actually forced in by FATF and we as a nation are turned to be helpless to say ‘no’ to the directions of FATF duly engineered by India and the USA. Let us discuss who brought the great idea of terrorism in Pakistan; the nation knows that first, it was a result of our own blunder by jumping into the war of USA with the USSR via Afghanistan. How the USSR was dragged into this war is part of the record of international spy agencies. The major suffering from this war was experienced by none but Pakistan and Afghanistan. We continue to suffer post 9/11 and facts remain that we have been suffering in the hands of America nonstop but we still do not realise and every time we are ready to suffer furthermore in their hand. The origin of money laundering started when cash dollars were distributed among the Mujahedeen dollars which were transported in US planes as the said war started with the USA funding.

The USA had been forcing us to do more but we did only which our sovereignty allowed us and we rejected to provide the data of our Pakistanis and it was me in the capacity of Interior Minister who declined to sign a MoU requested to me by General (R) Durrani followed by a pressing request by their Home Ministry. Now when I see all the sections of laws now have been made on the directions of FATF, in fact these are exactly the same demands which were made earlier made by the USA administration starting from Senator John Kerry to Secretary Hillary Clinton. Unfortunately, we have now been forced through the forum of FATF to agree to their terms. The Americans know that money laundering originated from the USA as worldwide business deals go through New York which is the main transfer hub of money transfers in dollars.

In my article “Attacking Pakistan’s Economy via FATF” dated October 21, 2019, I had expressed “I wish the government had informed the world that money laundering was not done by Pakistan but by those counties who created and supported the Jihadi organisations for their ulterior motives to keep the peace in Pakistan and Afghanistan disturbed. The creation and funding of Jihadi outfits came from the USA and also support from the wealthy Saudis and other business tycoons from the Middle East.” I had also mentioned in the same article “FATF is a joint effort of USA and India to undermine Pakistan’s efforts to eliminate terrorism and stabilise its economy. Pakistan should have demanded testimony from Condoleezza Rice and Hilary Clinton in Congress regarding who had launched these Jehadis. They had already made this frank confession which goes in favour of Pakistan & how they were funded & trained. The record of this confession by Hillary is, in fact, the right defence for Pakistan and it is strange to note that the government failed to put forth these important hard facts.”

Pakistan is the only country that has made so many changes in its law linking it with international interference and its benefit will go more to our enemy countries as the USA and other G- 7 countries will have the right to ask for secret information about Pakistan where our complete privacy will be compromised. The laws are not endorsed and are allowed to be passed by the FATF administration but our parliament did it. I happened to be part of this parliament and feel equally responsible but the collective response has made it happen. I fully endorse that the parliament has been made a rubber stamp and both Shahbaz Sharif and Chairman Bilawal Bhutto Zardari know who were absent from their parties from the house. Chairman Bilawal Bhutto Zardari has rightly termed this Parliament as rubber stamp but it is now up to the political leadership how they take out the blame of rubber stamp from the parliament. If this continues people are bound to lose their confidence in the Parliament. The fact is that the speaker remained confused, the opposition was less aggressive and it was overall a poor show. Reportedly the absence were marked from the Pakistan Muslim League-Nawaz (PML-N), and from the Pakistan People’s Party (PPP), the Jamiat Ulema-e-Islam-Fazl (JUI-F) and the National Party, two from the Awami National Party (ANP), from the Baloch National Party-Mengal and Baloch National Party Awami missed the joint session of Parliament. I noticed that some closest aides of both the top leadership of these parties were missing in the house. If all of these opposition members were present then there was no question of the defeat of the opposition. In the given situation the saga of the rubber stamp has also been contributed by the members of these parties.

I think accountability has to start from within the parties and all those members owe an explanation who remained absent except who were genuinely sick. Their absence amounted to ditching their respective parties. I am sure the respective leadership will ask them about their embarrassing absence from the house as it is even worse than floor crossing as it amounts to clever cheating of their respective parties. In fact, it will not be wrong to stay that parliament having the honour of receiving the “rubber stamp” is the production of the parliament itself. It is unfortunate that as long as the money is there to buy and sell a vote this practice will not stop. The political parties have a great chance to weed out those who ditched their parties for the reasons best known to them. At least this is an opportunity for their respective leaders to punish them even if they are from the close circle. We do have members who think that they are the “aqil kul” but many times I have seen them embarrassing their parties for quoting wrong references. This is the time for the leadership at all levels to stand on the basic principle of democracy and loyalties. The first count in the joint house appeared to be doubtful and that was the time to demand the division of votes and I did demand in high pitch but one of the senior leaders of PMLN opposed me there and I kept on insisting. The sense prevailed during half the session to walk out but our real complaint about the division of vote was rejected undemocratically and unconstitutionally by the speaker. This is Pakistan Parliament which will continue with the same distrust and internal clever cheating. Parliament owes an explanation to the nation and action against the temporary missing parliamentarians. Let there be a parliamentary inquiry to know what excuses come out to justify their absence from the Joint House. I have written this with a heavy heart what I saw or felt and hence no one should take it personally. Let us see how many show cause notices are issued to those who were absent. I am sorry for writing this blunt piece. I may not opt to be in parliament in the next term but this article will remind many to remain truthful and faithful to their parties as flu and fevers should not stop performing their national duty. Let us hope that there will be no rubber stamp “made in Parliament” in the future.

Quick renewal of Pak-Saudi ties by Senator A. Rehman Malik

 

Saudi Arabia has always acted as an elder brother by standing with Pakistan during the most difficult crises. It was HRH King Faysal bin Saud who sent spare parts for fighter jets and stood openly with Pakistan during the Indo-Pak war in 1965. There were many difficult moments where Saudi Arabia’s help cannot be forgotten as it remained as an all-weather friend with us. I recall those fond old memories which I experienced every time I went to Saudi Arabia and was received at the steps of the plane by the then HRH Crown Prince Mohummad Bin Naif, and every time my meeting with His excellency King Abdullah Bin Abdul Aziz used to last for hours and the discussion was mostly on South Asia and the Middle East. I remember how carefully and amicably the Saudi team handled the negotiations with Iran which were led by me on the initiative of President Asif Ali Zardari. They always expressed great thoughts for the people of Pakistan and Saudi authorities always have a special place for Pakistan. It will not be wrong to say that the relationship between Pakistan and Saudi Arabia has always been close and friendly. Pakistan, considered one of the strongest military states, has assumed the role of a guardian of host to the two holiest cities of Islam, Mecca and Medina, and the destination of Muslim pilgrims from across the world; Saudi Arabia, against any external or internal threat to the holy places.

Saudi Arabia has remained as the strongest supporter of Pakistan in the matter of Kashmir in the past; we need to examine and see what went wrong that Saudi Arabia decided to invest billions of dollars in India rather than in Pakistan. Both the countries have enjoyed sound political, diplomatic, military, and economic relations until recent times and a sudden change in the attitude of Saudi Arabia needs to be properly looked into and we must work out to identify and redress the misunderstanding through mutual discussions. HRH King Faisal Bin Abdul Aziz Al-Saud played a key dignitary role in holding the first-ever All Muslim Ummah conference in Pakistan which was initiated by Shaheed Zulfiqar Ali Bhutto. Pakistan and Saudi Arabia’s relationship have touched new heights under the strong leadership of HRH King Salman Bin Abdul Aziz. In 2018, on the request of Pakistan, he gave Pakistan $3 billion in aid and loans, of which $1.5 billion was deposited in Pakistan’s central bank. Further, a loan worth up to $3 billion was also given in deferred payments for oil imports to help stave off our current account crisis, while Saudi Arabia negotiated a bailout deal with the International Monetary Fund. During the same year, Saudi Arabia under HRH King Salman, announced plans to establish an oil refinery at Gwadar, with a proposed capacity of 500,000 barrels per day by investing $30 billion. In 2019, it paid $20 billion to finance developmental projects in Pakistan. HRH Prince Mohammad Bin Salman has also been taking keen interest in bringing new reforms to the Kingdom that includes economic reforms as well as strengthening relationships with other Muslim states.

As an honour to Pakistan, HRH King Salman Bin Abdul Aziz had also appointed our former COAS Raheel Sharif as the head of the Saudi-led, Islamic Military Alliance in 2017 which shows the strength of the relationship regardless of which party has been in power in Pakistan as both Nawaz and Peoples party had always respected the role of Saudi Arabia in the Islamic world.

It should also be noted that Imran Khan, upon becoming the Prime Minister had requested the HRH Crown Prince Mohammad Bin Salman to release hundreds of Pakistanis prisoners as an honour to his visit to Pakistan which was instantly agreed upon by his excellency. Why have we annoyed the kingdom with our undiplomatic approach? I also believe that the PM stance and his remarks about Yemen should be mentioned in some context as he criticized the role of the coalition in Yemen while Saudi Arabia had always stood beside Pakistan.

 During the 1990-1991 Persian Gulf War, Pakistan extended its military support to Saudi Arabia to protect the Islamic holy sites in Saudi Arabia by sending its troops.

In fact, the relationship started deteriorating when Gen. Mirza Aslam Beg, the then-chief of staff of the Pakistani army openly expressed support against the official policy of the then government by extending support to Saddam Hussein’s regime in Iraq which was a highly unbecoming move that annoyed Saudi leadership.

The wheel of time brought this investigation into my lap when I was director FIA and I was asked to look into the matter as to why Gen Aslam Baig announced the support to Sadam Hussain annoying the then govt so I investigated it thoroughly and submitted a report to Gen Babar, the then Interior Minister. This report revolves around a black briefcase which was recovered from a top businessman.

I also interrogated Mr. Younas Habib, the leading accused of the Mehran Bank scandal and a business tycoon but I will leave the details for some other time. I however also briefed then PM Shaheed Mohtarma Benazir Bhutto about some leads to New York found from the said black briefcase of a businessman.

Saudi Arabia was the only country that promised on the day of the nuclear test to supply free oil of 50,000 barrels per day to help Pakistan deal with likely economic sanctions by the US. Saudi Arabia was the first one to come in response to the 2005 earthquake in Azad Jammu Kashmir and Northern areas of Pakistan. The then King Abdullah Bin Abdul Aziz had announced an emergency aid package worth 133 million dollars for Pakistan and other crucial support.

Nawaz Sharif had best of the best relations with Saudi Arabia and so the country went out of the way to get him out of jail under General Pervez Musharraf’s regime and then moments came when Saudi Prince Muqrin came with a special letter from King Abdullah Bin Abdul Aziz addressed to Nawaz Sharif to spare the life of General Pervez Musharraf and not to register a case against him during the PPP & PML N coalition govt. Why Saudi Arabia had to request Nawaz Sharif is a long historic part of our history which will be written in the form of a book with surprising facts. The fact remains that there had been great interest in Pakistan by Saudi Arabia and this sudden change in the attitude of Saudi Arabia needs to be analysed.

Saudi Arabia is the largest source of petroleum for Pakistan. In 2018, on the request of Pakistan, it gave Pakistan $3 billion in aid and loans, of which $1.5 billion was deposited in Pakistan’s central bank. “Lately, Saudi Arabia had announced to end the loan and oil supply deal with Pakistan along with forcing Pakistan to repay $1 billion loans after the aggressive statement by Foreign Minister Shah Mehmood Qureshi that Saudi Arabia led the Organisation of Islamic Cooperation (OIC) was not doing enough to pressure India on the Kashmir issue. He in his statement had warned the Saudi-led Organization of Islamic Cooperation (OIC) that if it didn’t convene a meeting of the OIC’s Council of Foreign Ministers to discuss Indian aggression towards Jammu and Kashmir as well as the revocation of Article 370 by India on August 5 last year, Pakistan would move to call a meeting of Islamic countries that would stand by it on the Kashmir issue.” The sudden undiplomatic expression by Shah Mehmood Qureshi has cost us heavily resulting in the breakdown of our relations with Saudi Arabia. This statement was obviously not liked by Saudi authorities, hence, they forced Pakistan to return $1 billion. This recent unfriendly situation arose because an undiplomatic statement of FM needs to be examined at depth should be rectified. The nation needs to know if this statement was delivered on his own or it has the input of the senior leaders of his party or duly cleared by the PTI cabinet. If he had given this statement on his own, then he owes an explanation to the nation and if this statement was given under the directions of the PM then PM needs to come to the Parliament to give his explanation. I am left with no other option except to raise in the house on point of order and will continue my efforts unless I get the inside response. The govt should be open in stating as to why our relationship with Saudi Arabia have gone bad? Why it is being kept hidden even from the parliament? It is unfortunate that Saudi-Pak relations were dented twice by two Pakistani individuals at positions of authority for their unwarranted and undiplomatic statements annoying Saudi authorities. This statement has created odd relations between the two friendly countries and it is the right of the public to know about the real background as now, unfortunately, we have gone to the lower end of a friendship and we need to improve it by using all our resources. We should not lose our great friend Saudi Arabia like this and let us hope that Pakistan tries the mediation of UAE or Egypt to clear the misunderstandings with Saudi Arabia without wasting any further time. We have no option except to restore our relations with Saudi Arabia and my sources say that a western country will play its role to get it sorted through the leaders who matter on both sides.

Israel: Emerging might with rock-solid US backing by Senator A. Rehman Malik

Israel is now emerging as a mighty power due to solid support from the USA during the recent past. It seems that both the US and Israel have solidified their co-existence and both are moving with a specific agenda. Let us discuss how the west brought Israel into existence and how it was planted in the middle of the Arab world. The conflict of Israel and Palestine was bound to surface and the heavy loss of lives it resulted into, which has continued till today.

Initially, Pakistan had support from all countries of Muslim the world against this newly-emerged state, but with the passage of time many Muslim countries gradually decreased their support whereas Pakistan stood for the cause of Palestine till today. Palestine was part of the Ottoman Empire, Britain seized it after World War I and in 1917, Britain raised the issue for a “national home for the Jewish people” in Palestine, paving the way for present-day Israel. The Balfour Declaration was the effort of Britain which demanded protection for Arabs, but there was no mention of their political or national rights.

When the British mandate over the lands of Palestine began in 1922, the Jewish population was only about nine percent; this number increased to nearly 27 percent by 1935 with the immigration of European Jews under British allowance. Israel was formally established after World War II when Holocaust became one of the major reasons for Jews to have a separate homeland for themselves, who were massacred in Europe in the 1940s under the Nazi regime.

Hence, mass migration of Jews to Palestine started to happen despite the fact that in 1939, it was stated in a British white paper that it would undertake a yearly migration of only 10,000 persons to Palestine. Eventually after WWII, the United Nations General Assembly passed a resolution calling for Palestine to be divided between Arabs and Jews on November 29, 1947. This finally led to the establishment of Israel.

Israel by design and planning started working hard and its second generation have taken over almost the entire print and electronic media and especially took over the financial institutions and made their way into US politics. Israelis have become so powerful that the elections in the US in terms of donations, have got high dependence on Israeli business community funding. Israel used the US in the UN and ensured that the USA had a leading role in protecting their diplomacy. The massacre by Israel by design in Palestine in order to bring demographic changes and from 20 percent of their land they have extended to 80 percent on Palestinian land. The massacre was so bad that the Palestinian Muslims were forced to migrate by leaving their lands and it will not be wrong to say that Israel managed to not only grab the land but also develop their technology which they sold out to the world including Muslim countries under European brands.

The demographic changes/reduction of Kashmir are the same model of killings of Palestinians by Israel which has been adopted by the Indian Prime Minister Narendra Modi.

Mossad is a child of the CIA but Mossad is now more competent and lethal. The way Israel has handled Hamas and other Palestinian organisations and its penetration in the camp of Yasir Arafat actually dented Palestine. A number of attempts were made on Yasir Arafat’s life and it is believed that Yasir Arafat was killed through slow poison by using his own people involved there.

I had written in my Article published under the name of “Setting the stage; Kashmir, Ladakh and World War III” in which I had stated as under: - The world must not forget that Israel is watching as a third party and it may jump in it once all these countries are made weak like in WW-I. Let us not forget that India has already accommodated Israel to use all of its defence and hardware and the US is India’s preferred defence partner. If war begins, then expect Israel to play its last role to convert it into a victory for the US. In the given situation, Pakistan as a nuclear state cannot remain isolated if this war erupts and will have no choice except to be on the side of China.

It looks that there will be tremendous pressure on the Arab world from the US to recognise Israel.

In reference to relation of Pakistan, the statement by the founder of Pakistan, Quaid-e-Azam Muhammad Ali Jinnah on October 12, 1945 is on record that which is reproduced as under:

“Every man and woman of the Muslim world will die before Jewry seizes Jerusalem. I hope the Jews will not succeed in their nefarious designs and I wish Britain and America should keep their hand off and then I will see how the Jews conquer Jerusalem. The Jews, over half a million, have already been accommodated in Jerusalem against the wishes of the people. May I know which other country has accommodated them? If domination and exploitation are carried now, there will be no peace and end of wars.”

The above statement shows the resentment of Quaid against the illegal control of Israel on the legitimate land of Palestine.

Israel has a strong influence over the US, as there are more than 8 million Jews living in the USA. Israel with the passage of time will become stronger than America for many reasons and perhaps America also knows its capabilities and hence it is going along with Israel.

 The Muslim states including Pakistan need to work out on the new world order which may come on the emergence of Israel with its mighty Mossad and high technology. We need to worry because Israel is the preferred defence partner of India. It should also be worrying for us that Israel has now ingressed into our Arab neighborhood. Now time will tell us as to how many more Arab countries will recognise it and what impact will come on the world, particularly in our region.

Let see the emergence list of August 2020, 163 of the 193 UN member states recognise Israel; thirty UN member states do not recognise Israel. These include 17 of the 22 members of the Arab League: Algeria, Bahrain, Comoros, Djibouti, Iraq, Kuwait, Lebanon, Libya, Morocco, Oman, Qatar, Saudi Arabia, Somalia, Sudan, Syria, Tunisia and Yemen. A further nine are members of Organisation of Islamic Cooperation: Afghanistan, Bangladesh, Brunei, Indonesia, Iran, Malaysia, Mali, Niger and Pakistan. The other countries that do not recognise Israel are Bhutan, Cuba, North Korea and Venezuela.

Muslims countries that recognise Israel:

Turkey was the first Muslim country to recognise Israel in 1949 while the relationship has been uneven since their 2010 nadir. Other Muslim countries to have recognised Israel are Jordan, Egypt, Iran and UAE.

The above status of Israel indicates how Israel has penetrated all continents.

Pakistan will have to work out the growing risk as result of the new close partnership between Israel and India. It has been reported that India has deployed Israeli defence advisors and India has already given access to American and Israeli defence experts to design the counter war strategy against China. I have shown my apprehensions that the USA and Israel may use PM Modi for their evil designs in the region and this unholy partnership will imbalance this region with RSS-trained PM Modi who has been convincing his people that he can finish the war in ten days against Pakistan. This miscommunication can lead to major conflict in the region. This mindset is likely to destroy regional peace.

The Muslim world must take note of ill motives of mighty Israel against them. They must be aware of forthcoming trap to further dilute the unity within the Muslim world.

Let us pray for the guidance and blessings of Almighty Allah enabling the Muslim Umah to counter the evil designs of our enemies.

India has gone by default in the hands of notorious criminals who came to power with their own criminal writ, and both remained openly involved in their criminal activities including mass killings and murdering selected opponents through police encounters and highly-trained RSS agents. India has been invaded by RSS, headed by PM Modi and his old partner in crime; now the Home Minister and the architect of controversial laws against Indian Muslims and oppressed Kashmiri Muslims under curfew. It is only PM Modi who could have given such a highly sensitive portfolio of the Ministry of Home Affairs to a criminal.

Several journalists with a conscience were courageous enough to speak out against the gross violations by the Indian government, patronised by RSS during the engineered massacre of Muslims in Gujrat, following the Godhra train incident in 2002. I am quoting here the revelations made by well-known Indian investigative journalist Rana Ayyub, in her book “Gujarat Files: Anatomy of a Cover Up”. The crux of her investigation, pertaining to Amit Shah, now Union Home Minister of India, is as follows;

 “…the then Gujarat home minister, Amit Shah was involved in the killing of the three Muslims who were falsely accused of terrorism by accusing them of being members of ‘Lashkar-e-Taiba’. Three weeks later, Amit Shah was arrested on charges of orchestrating the killings. He was put into jail after a trial in 2014 for ordering the fake encounters of ‘Sohrabuddin Sheikh’, his wife ‘Kauserbi’ and murder of witness ‘Tulsiram Prajapati’. These three innocent Muslims were all killed in 2005 and 2006.”

Azam Khan, a contract killer, was given the contract to kill former Gujarat home minister Haren Pandya by police officer D G Vanzara in 2003. The murder of the former home minister still remains a mystery, as neither police nor CBI got themselves involved in this while his family kept calling it a political murder. In 2010, the sole testament and consistent witness of the case, Azam Khan, was also eliminated through assassination.

According to the investigations, when Shaikh and his wife Kauserbi were travelling from Hyderabad to Sangli in a bus in November, 2005, the Gujarat and Rajasthan police stopped them and shot them dead near Gandhinagar. The wife Kausarbi, was also allegedly raped by a sub-inspector before being murdered. The Gujarat police falsely claimed that Sheikh had links with Pakistani terror group Lashkar-e-Taiba, and that he had a plan to kill the chief minister of the time, Narendra Modi. However, a Special Investigation Team constituted by the Supreme Court later found that they had been killed in a fake encounter. On the other hand, Prajapati, being the sole witness of the murders, was also shot dead in police custody in December 2006. During investigation, the police claimed that he was trying to escape.

The first arrests made were of deputy inspector general D G Vanzara and Rajasthan police officer Dinesh MN. The Crime Investigation Department gathered phone calls records that revealed frequent phone calls of Amit Shah with D G Vanzara, Dinesh, superintendents of police Rajkumar Pandian and Vipul Kumar. The call records from September 2006 to January 2007 revealed that Amit Shah consistently remained in touch with D G Vanzara and Pandian during that short period of time around all three killings. The number of calls increased every time there were developments in the case. The Gujarat CID report pointed out that the frequency of these calls was unnatural and uncommon in nature as they were against the minister’s official protocol. The police officials involved in the encounter remained in jail since 2007 and were granted bail in 2014. After they were arrested, the investigating officer was transferred and the case was handed over to Inspector General Geeta Johri, who was later criticised by the Supreme Court for not conducting a fair investigation.

It is evident that all the witnesses were systematically eliminated through assassinations, and in each case, the police’s complicity was beyond doubt.

Essentially, Amit Shah used the police to kill Mr and Mrs Sheikh, and the eye witness. It was extremely unfortunate that a sub-inspector, holding a position of trust, raped Mrs. Shiekh before murdering her. Unfortunately, he had full backing of Narendra Modi, who was then Chief Minister. Ironically, Narendra Modi upon being sworn in as PM of India, rewarded Amit Shah by securing him a berth in his cabinet, as Union Home Minister, a position, where he has a free hand to commit murders and assassinations in the name of Hindutva. The Narendra Modi and Amit Shah duo has earned the notorious title of ‘ranga billa’, implying that whosoever crosses their path, meets the fate of the witnesses and Judge Loya of the Gujrat massacre case.

Such was the terror of extra-judicial murders by the ‘Chankya of modern times’, Amit Shah, and the ‘Butcher of Gujrat’, Narendra Modi, that none dared to step up and give evidence against either.

Under the duress of then CM Gujrat, Narendra Modi, Rana Ayyub was prevented to publish her findings in the then famous exposé magazine Tehlka that demonstrated Narendra Modi’s central dominating role in the massacre.

A sole witness of Narendra Modi’s involvement in the massacre was Sanjiv Bhatt, a former Indian Police Service officer from Gujarat. He is known for his role in filing an affidavit on April 11, 2011 in the Supreme Court of India against the then Chief Minister of the Government of Gujarat, Narendra Modi, concerning Modi’s alleged role in the 2002 Gujarat riots.

He claimed to have attended a meeting at Modi’s residence, during which Modi allegedly asked top police officials to let Hindus vent their anger against the Muslims.

 After the 2002 riots, a group of social activists had formed the Concerned Citizens Tribunal to analyse the riots. Gujarat’s home minister Haren Pandya (who was mysteriously killed later) had allegedly told this tribunal that Modi had organised a meeting of several police officers on 27 February 2002 after the Godhra train burning, in which over 63 Hindu pilgrims had died. Pandya claimed that, in this meeting, Modi had asked the police officials not to come in the way of “the Hindu backlash against Muslims”. Pandya had named several police officials who attended this meeting and he was later assassinated by unidentified men.

Bhatt in his affidavit, had mentioned six witnesses, who could testify his presence in the alleged meeting held at Modi’s residence but later-on, KD Panth, the prime witness was turned hostile to help Modi escape any negative outcome. Bhatt was suspended on August 8, 2011 by the Gujarat government, accusing him of unauthorised absence from duty. He was contacted many times by Amit Shah and Modi’s agents to destroy all the evidence against them. Eventually, he was dismissed from police service on the basis of the same grounds of “unauthorized absence” in August 2015. Apparently, the witness is still alive, and may be willing to provide evidence if protection is assured to him.

The above pattern of violations by RSS, BJP, Indian Government of Modi clearly suggests beyond any doubt that the present Indian state under Prime Minister Modi are bent upon increasing religious violations against Muslims, forcing them to either convert or get ready to be killed. To meet the ends of justice, it is important that, investigative journalist, Ms Rana Ayyub, along with other living witnesses must be invited by some international forum to offer their evidence and reveal the facts that led to the carnage at Gujrat, now remembered as the Muslim Massacre. It will be in the interest of justice if the head of the Aam Aadmi Party Mr Arvind Kejriwal is also called as a witness along with other victims, who suffered at the hands of RSS, to record the statements before the same forum. The downgrading of India to “Countries of Particular Concern (CPC)” through the 2020 USCIRF report, is insufficient to convince India to cease the atrocities unleashed through RSS and Hindutva, against Muslims and Minorities in India.

Besides the above brutalities and criminal activities, both are continuing to carry out religious violations against oppressed Kashmiris unhindered, as Kashmiri Muslims are now subject to torture by Indian troops under curfew since the last seven months.

Their only fault is that they are Muslims and are voicing for their right of self determination. Will anybody from the world answer their calls?

I intend to write to the relevant forums, including the US Commission on International Religious Freedom to examine the criminal role of these old partners involved in crimes against humanity in the light of new evidence.

I urge the international community to form a high-powered commission in the interest of humanity, and religious freedom, maybe proposed by the UN, to investigate these violations, and to place India under international sanctions until the right of life of Muslims and other minorities is ensured. PM Modi has ordered violations at the LoC to divert the international attention from IOK and his political blunders, leading to massive unrest in India. Both partners in crime are upset with new evidence as it may lead to their trials as war criminals in the International Criminal Court.
